DRP Don't Understand What Is Meant By A "Loss"

A CAG poster has received this load of nonsense when he asked for a genuine pre-estimate of loss being claimed by Parking Eye. Read and enjoy:-

The outstanding Parking Charge amount has been calculated as a genuine pre-estimate of loss as our client incurs significant costs in managing this car park to ensure motorists comply with the stated terms and conditions and to follow up any breaches of these. These costs include (but are not restricted to);
• Erection and maintenance of the site signage.
• Installation, monitoring and maintenance of the Automatic Number Plate Recognition
systems.
• Employment of office-based administrative staff.
• Membership and other fees required to manage the business effectively including
those paid to the SPA, DVLA and ICO.
• General costs including stationery, postage, etc.
This sum, and the calculations which have been made in setting it, has been approved and agreed by the landowner (or the landowner's agent). The amount charged was also clearly laid out on the signage at the site, and by remaining on site, we contend that the motorist has accepted all of the prevailing terms and conditions of that contract, including the
charges for breach of contract.

Once again another load of idiots who don't understand the difference between costs and losses.

    All they need to do is to reply asking exactly how they had incurred any of those costs by the specific alleged parking event they are claiming for. Apart from a small amount for stationery, they have lost zero with respect to that specific parking event.

    How about using that for every appeal to popla, and every small claim they initiate ? Is it in the form of an image ?
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    I have been asked for assistance by someone who has been ignoring letters from Parking Eye, and has now received a letter before action. Interestingly the LBA is on PE headed paper (ie not from debt recovery or solicitors).

    In the light of this thread, I am considering suggesting that he writes to PE with a request for a genuine pre-estimate of loss - would you agree, or just let sleeping dogs lie and see if court proceedings are initiated?

    For further info this was a Welcome Break (oxford) penalty charge. I have yet to ask how the charge arose but I am guessing that the driver fell asleep and overstayed the free two hours. I notice from WElcome Break website There is provision to pay £10 for 24hrs parking so would I be right in saying that any loss should be restricted to £10 + a small admin fee? In which case is it worth making that offer on a without prejudice basis?
