Thats what it says on the "witness statement"
Are Parking Eye trying to say that they are the owner of the land and the lessee of the site???
At the bottom of the statement it says, for and on behalf of Parking Eye.
Which is where the landowner title usually is??
Is it a mistake or not???0 -

Just spat my [STRIKE]whisky[/STRIKE] coffee out when I read that.
Also noted here was no authority to pursue through the courts. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

UNITED4EVA - thanks for this.
Unless Parking Eye actually do lease that site and are now selling pre-owned redundant clamps, their basic understanding of the concept of landowner and lessee is pitiful.
Use your POPLA code and appeal on no valid contract - as well as the rest. and refer POPLA to the useless witness statement where it is clear that they have no valid contract.
Totally unbelievable!!!!!!
ps. Hope they have banged out lots more like that.0 -
Thanks Guys Dad,
I have just sent another email to Popla stating all of this.
Lets see what happens next??0 -
So, just to clarify ......
PE claim to own Tower Road, Newquay?
A director of PE has signed his name to a witness statement stating this to be true?
I only have one word to say to PE (because I know they love to read this site) .....BUFFOONS!The word "gullible" isn't in the dictionaryTickets: 19 [cancelled: 18, paid: 0, pending: 1]

Well, I guess that's a 'Statement of Truth' then, which I understand has significant meaning in the legal world.
I wonder if daisy has a view on this? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Hmmm am I missing something here? How can they be the owner and leasee at the same time? Surely it would be one or the other and not both? When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
