This has given us the perfect appeal against the new POPLA witness statement. PPC must be put to strict proof to supplement any witness statement with a letter from the landowner on landowner's headed notepaper that the landowner witness is employed by or a director of landowner's company and has had sight of the contract referred to. Reason being is POPLA has had evidence of a PPC fraudulently signing a template witness statement claiming to be landowner.

Please could UNITED4EVA or anyone else on this thread who knows the outcome, please confirm that the appeal was successful? This is very 'close to home' for me and the evidence will be really useful if, as it seems from the above comments, it should be.

Joe this thread is about a narrow reason for appeal to POPLA about the production of contracts and the substitution of a witness statement.
In reality POPLA appeals are normally won on other grounds - one of the strongest is the failure by the PPC to show a 'genuine pre-estimate of loss'.
If you have not already done so, I suggest that you go to the POPLA DEcisions thread at the top of this forum and read the last few pages. You will soon get a feel for what arguments win at POPLA.

PS Yes, I've looked at the POPLA decisions thread, but I still feel that half the problem is that there's so much information on so many different threads I can't filter what's most relevant for me! It seemed like this one was ideal.0
