If there is a wayleave for BT, I would have thought it would have shown up at the time of purchase of the property. Did solicitor mention it at time of purchase?
Has the drive been widened or re-routed at any time, which could account for pole now being in an inconvenient place?
I've lived in the home for 2 years.
There is no wayleave, as confirmed by BT themselves.
Not mentioned by the solicitors during purchase, mainly because there are no details showing it's existance as there is no wayleave.
Drive has never been widened or re-routed at any point as all the drives are the same on the street, only mine has a stupid pole stuck on it.Now a proud home owner after saving a deposit for 2 years :j0 -
No, it's actually the only pole in the street and serves 15 homes.
It is connected to my home but I don't use BT as my phone provider so the pole serves no purpose to me.
I had this year's ago, a lot of years ago however so things may have changed. We were adding to our property and it was in the way. Again serving all the cottages in the lane. They had to move it, at their cost and to our wishes, and I seem to remember us having to agree they could use our land and also i'm sure they actually paid us some money for the privilage.
Nothing came up on our deeds or surveys either at time of purchase.Yep...still at it, working out how to retire early.:D....... Going to have to rethink that scenario as have been screwed over by the company. A work in progress.0 -
Send them notice that you will be removing the pole on a specific date three months from now and see what their response is. Remember to include an invoice for the cost of cutting it down and disposal. You could put leaflets through the neighbour's doors letting them know that their phone service will be ending on that day too.0

I also remember someone getting anti about where the pole was going to be put (one of the neighbours)..still on our land , and we had the right to refuse access to them (as cables went through our roof to them) or charge them a fee....they soon backed down. in the end it was decided better for everyone for the cables to be put underground.Yep...still at it, working out how to retire early.:D....... Going to have to rethink that scenario as have been screwed over by the company. A work in progress.0

I think that will come under the category of criminal damage - not a particularly wise suggestion.0 -
Also, what happens if it comes down, gets hit by lightening or another car. Also, what happens if they do need to work on it, will you arrive home one day with a cherry picker parked across your drive/flower bed.0

Legal cover on your home insurance? It is nice to see the value of your house going up'' Why ?
Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
If you are planning to upsize the new house will cost more.
If you are planning to downsize your new house will cost more than it should
If you are trying to buy your first house its almost impossible.0 -
I wrote a thread on this very issue a while back! Was this a move by BT years ago to potentially cash in in the future?! :rotfl:
Anyway, I never pursued mines, but will be watching to see how yours turns out. Good luck!
Bought is to buy. Brought is to bring.0 -
I'm currently pursuing them about a metal bracket attached to the side of my house that holds a BT phone line going to the neighbour's house. They should at least be paying rent on it.0
