BT pole on my property

    How old is your home? Sometimes poles and other things are there and builders just build round or over them.

    It's not clear to me why there would be such a pole if there were no houses surrounding it to serve

    Further, the matter of pole placement is not one of the things regulated by Ofcom, so one can't complain to them if Openreach decide to drag their feet.

    My problem stemmed from a neighbour relocating a pole from his land to mine during works to rectify a lightning strike. There was collusion by a contractor used by Openreach, who just happens to be a mate of the neighbour.

    As the pole is illegal and only serves the neighbour, I could arrange an 'accident' while having my ditch cleared.....but to be honest, I'd rather have it repositioned so I keep control of it, and the money! ;)

    I have PM'd you on this. :)

    For others, a quick update:




    • exactly 10 weeks after his visit, I emailed the Openreach surveyor to ask what was happening
    • immediate apologies and a promise of paperwork within days
    • as promised paperwork quickly arrived from Wayleaves offering the usual fee + an amount as compensation...
    • ....however, the map showing the proposed position of the pole was wrong. It showed it on a neighbouring farmer's land. confused-smiley-013.gif
    • further emails from me to surveyor and Wayleaves two days ago
    • silence.....:mad:

    Update: New (correct) map + papers received last week and returned, signed.

    Cheque for wayleave + additional amount received last Friday. :beer:

    Now it just needs to be moved......
  • Ok, I have received the following from BT:

    "Counter-Notice pursuant to paragraph 21) of the electronic communications code (Telecommunications act 1984 schedule 2 as amended by schedule 3 to the communications act 2003): Notice of refusal to carry out alterations to electronic communications apparatus.

    British Telecommunications plc:

    1) Hereby acknowledges recipt of your undated notice received on the 29th August pursuant to paragraph 20 and 21 of the electronic communications code requiring it to alter certain electronic communications apparatus upon the property.

    2) Hereby gives you as freeholder of the land upon which the property stands notice that British Telecommunications plc is not willing to comply with your request to carry out the requested works.

    Your attentions is drawn to the explanatory notes as to the effect of paragrapy 20 and 21 of the electronic communications code, as set out below.

    Can anyone advise of what my next step should be? Clearly they are refusing to move the pole or even provide any way leave payments.
    It seems ridiculous just because they are a big company they can just go around putting things where they like and get away with it. :mad:

    ....bad attack of woodworm or the like?:think:...followed by letter to BT stating that their pole does look rather hazardous and they might like to remove it in order to save any risk of it falling on someone's head ...followed by a compensation claim???:cool:

    Sometimes that way of thinking turns out to be the only way to deal with State (or former State) bodies determined to "act ignorant" and trying to forget about their responsibilities....

    If there is one thing that is calculated to give them a case of the Screaming Habdabs that's it...
  • How long has OP lived in the house? Is it registered with HMLR, or does OP have old style deeds?

    If there is a wayleave for BT, I would have thought it would have shown up at the time of purchase of the property. Did solicitor mention it at time of purchase?

    Has the drive been widened or re-routed at any time, which could account for pole now being in an inconvenient place?
