Hi,
I've followed your posts with interest and wanted to say thanks for posting. I'm about to embark on the same process with Openreach. I have a telegraph pole in an awkward location on a building plot I've just bought. There is no wayleave in place and I'd like it moved. So far all of my enquiries with BT have been met with 'place an order and pay £200 for a survey and a surveyor will investigate'.
I'd enquired about getting it moved during my due diligence when I made the offer and the sellers got an Openreach surveyor out to the plot and reported the options. They can move to the edge of my plot. When I contacted them to request them to progress the move I just get 'place an order pay £200...'.
My architect has advised 'serving notice on them' but I wasn't sure who I need to write to? Any advice based on your experience would be great.

If there is no wayleave in place, you can require BT Openreach to move the pole, BUT if you are 'improving' (i.e. developing) the land, as you appear to be, then I'm afraid you will have to pay their expenses for doing this.

Hi I have a BT pole on my land that I want moved. I have checked with Openreach and there is no wayleaves agreement in place. The lady on the phone offered to put an agreement in place but I really want it moved.
I understand that I can submit an official noticeto ask them to remove it under the Telecommunications Act 1984 but does anyone know the exact wording I need to use so that my request is noticed and not rejected? Also an address?
I know many of you will say it is a solicitors job but I don't have the money to go down this route.

Red_debs, there's a distinction between asking BT/Openreach to move an illegal pole within your property to a convenient spot, and asking them to remove it altogether.
In the latter case they'd have to find another home for it, probably among other reluctant land owners. For this reason, they are less likely to grant removal, and it's worth bearing in mind that they have the power to override the usual procedures in really difficult circumstances.

In my letter I included this paragraph:
" In the light of the above, we are now demanding that you remove your installed line equipment from our land within 28 days of receipt of this letter, as detailed under Paragraph 21 of The Telecommunications Code, Schedule 2, Paragraph 2 of the Telecommunications Act 1984, as amended by the Communications Act 2003 (The Code)."
I think the other details are probably within this thread, but if there's anything specific I haven't covered, please ask.
