Excel HELP, I have read others but...

Hi all, I realise there are many many posts on here about the same but..

I got 2 fines for parking in the FREE bays at KFC and exceeding the 15 min time frame, as you would expect, no human can queue up, pay and eat a full meal in that time..

After reading loads of threads about Excel I ignored the letters, these 'fines' date back to Feb 2013, I have just had probably the 4th sets of letters from Roxburghe Debt Collectors saying they are reducing the amount and I have already received letters from Graham White.

Any advice on what to do now as it is probably too late to contact but I feel its always hanging over me!!

HELP!!:(

You are past any ability to appeal so ignoring is the correct way to go. If you've got to the Graham White letters ( they're not a proper solicitors ! ) then you're near the end for the first PCN.

Look at it logically, why would Roxburghe offer a discount after you've ignored the original offers ? Because they know they don't have a leg to stand on.

Keep ignoring and come back if you ever get nervous.

    Peel Centre Stockport?

Loads of recent threads about Excel's little game there. Shame you are too late to appeal now as you'd have won it at POPLA and wouldn't have had to put up with their junk mail for months!

Read the PPC letter chains thread link to the OLD pre-October 2012 letters (because that's where you will find the pics of the Excel letter chain):

    https://forums.moneysavingexpert.com/discussion/2329119

You are in ignore mode so stay there all the time it's only junk mail. All Roxburghe/Graham White letters are shown linked under several PPCs.

If Excel decided to try a small claim you'd obviously have to respond and defend it (and win) but I haven't seen more than 1 or 2 Excel small claims made this year (as seen posted on forums anyway). I can think of just ONE at the moment and that's where - astonishingly - they are after a disabled man for parking in a disabled bay.

Excel seem to be just doing the usual junk mail thing in 99.99% of cases at the moment and maybe are waiting to see Parking Eye crash and burn with their small claims first. Excel and sister company VCS also have 'form' for ridiculously badly-argued claims which are laughed out of Court so this isn't anything to worry about.

We don't think they are in a hurry to repeat VCS v Ibbotson from last year! Look at the link under VCS on that letter chains thread and laugh at their incompetence! :rotfl:

I was aware after reading various posts on here they couldn't do much?

    I am worried now?

    Are you?

Why are you worrying about a phone call? (Why do they even HAVE your phone number?) Phone calls are not enforceable ... you should only worry if you receive actual court papers, or letters headed:

    Letter Before County Court Claim
    Letter Before Action
Notice of Intended Court Action in X Days

So continue to ignore, and come back here if you receive any of the above.
  • Ok, thank you, can I just say there is no need to be like that, I am genuine and I have never been in this situation before, I am scared yes, I do not have £300+ to pay these people and I have followed every ones advice since my 1st ticket in Feb which was to ignore, now they are calling me threatening me with court, excuse me for being scared. Once again thank you.

I was being a pedant ... you ended the sentence with ? so you were asking US if you were worried; I was asking if you were, since there's no way WE would know. ;)
  • Pedantic then? Thank you for your help, so to clarify, have you, in your experience had anyone else who has received a call from Newlyn? I said I didn't know what she was talking about and it wasn't me, she kept on saying "why do you say it wasn't you" she also said they wouldn't be contacting me again but they will have to take further action? Sorry to keep asking questions but yes I am worried now, also good question, how do they even have my phone number?
