  • I appealed using Parking Eye's online form to the £70 charge they sent us last week. I copied the paragraph from Martin's template letter regarding the fee being disproportionate.

Got an email this week saying the charge has been removed.

Result. Thanks to everyone and this forum for help.

Very well done, but must say I'm amazed they just rolled over like this.

Maybe they knew that POPLA was their next destination - and they lose every time there when a forum-assisted appeal is submitted.

You've just done them a favour and saved them the £32 POPLA fee - they're obviously showing their gratitude with a cancellation :)

  • Hi Postalworker - thanks for posting. I've asked a board guide to take your post and create a new thread for you.

As explained via Facebook, Coupon Mad is the Queen of the Equality Act and so will be able to give decent advice.

IMO, I would write a Letter Before Action to both Aldi and Parking Eye stating that your were entitled to extra time due to the blue badge and so they have both broken the Equality Act 2010. You should also point out they have broken the British Parking Association Code of Practice which says cars displaying blue badges should not be "ticketed".

The caveat is that you will need to be prepared to go through with issuing a claim - this is fairly easy though.

Chances of a refund are somewhere between zero and zilch, I'm afraid.

Only way might be to badger Aldi. Bombard their FaceBook page, but there's already 2 on there today who've knee-jerked into paying and are now looking for ways to get a refund - and there's no reaction from Aldi to aid their plight.

If I'm honest I think you're probably wasting your time whatever action you choose.

If you want any more advice (but I really don't think there is any more) please start a new thread so that you get it specifically related to your circumstances.

Yeah, I was a tad surprised too. Maybe like you said they spotted the form-assisted appeal copy and figured it was not worth it.

I forgot to mention I also attached my bank statement showing the amount we spent there on the day in question. Not sure if that helped.

The bank statement was absolutely the 'silver bullet' here, I'm sure. I've yet to see PE reject any appeal where receipts or bank/cc statements are produced showing purchases on the day.

I think we should really be pushing this line now with PE cases as probably the easiest way to get PE charges cancelled - as long as they haven't already started legal proceedings, then you're up against their £50 nonsense!

As I've said before, I'm sure their contracts contain some clauses linked to this.

If he was by any chance schizophrenic, he could complain to himself and be told it is nothing to do with his alter-ego.

Where did you get the information, by the way???
