There is no such duty in criminal law. It is criminal damage plain and simple. There are very few situations where you can justifiably damage someone else's property (to prevent serious harm or injury etc). Saving costs does not satisfy this. Personally I hope the Police deal with this robustly.
Been there done that CPS agreed I had "Lawful authority" to protect my property, my business and my money being my property.
Saying that I don't agree with what they did, there are ways to move a car without needing to smash a window, but I can see it from the other side.
The story:
Dipstick parked across my gates 3 lorries cant get in for the night. I gets in Range rover, no towing eye on car employee ties rope to car unfortunately the coil spring. I pull, car moves a few feet then coil spring comes flying out attached to rope. Reattach rope move car out of way. Left note on car owner pi55ed reports me to police. file sent to CPS, they decided I had lawful excuse and had used reasonable methods of protecting my own property.0 -

Well they are in the Flintshire Chronicle again today for refusing the local council's request to refund people who were caught by the ANPR system they installed without planning permission.0

Well they still haven't refunded anyone in Dunstable and their behaviour there was far worse i.e. pretending that the car park was for customer use only when the planning permission (s106) said it was free for anyone to use.Je suis Charlie.0
