Hi guys,
Just thought I'd add my experiences so far.
In Jan 2010, I signed up to have my roof repaired and coated, via the great team of roofers that Aquashield employed..... Needless to say, two years later, the roof now leaks as they managed to rip the felt under-skin when they were replacing a few broken tiles, and the tiles have all faded to randomly different colours, which looks rather naff.
In Sept last year, I also got the letter from Customer Reclaim, and been rather quick-reacting, rather than actually thinking about it, I agreed for them to take my case. I filled out the form they sent asking for the details, and returned it to them the following week. I received a reply stating that I had a VERY strong case, and that things should be sorted fairly quickly, as the evidence appeared to be watertight (unlike my roof!!). Since then, almost 4 full months later, absolutely no contact. So I rang them earlier this week, in which they said they have contacted Hitachi Finance, and it is with their legal department. I was advised not to expect any outcome until at least end of March. So, 6 months from start to (hopefully) case settlement.
Reading a few cases on here, it seems that had I tried to sort this out myself, I might have already had everything sorted by now. Ah well, such is life.
So, I will continue with the updates, as I receive them.

I'm going back to them again with a more detailed letter, again with sales material, they keep trying to say my alleged conversations aren't proof so I'm having to keep telling them I'm not alleging these things were spoken, I'm telling them that it was in sales material given to me, and another photocopy sent to them.
The last letter they told me that it was time barred, and I've had to explain to them that under Sct75 CCA there is NO time bar, and it should be from the time of finding out about the mis-sale and mis-representation, just the very same as if matters were time barred at 5 years in Scotland or 6 years in England and Wales most PPI claimants wouldn't have gotten any money back.
So I've asked them now either to find in my favour or give me their Final Decision so that I can take it to higher authorities, let's see how this goes now.Thanks to all the competition posters.0 -
I just got a full refund from GE, no need to go through any lawyers. All it took was a few letters written to them, a roofing expert sent to my house to confirm the job done was not up to standard then had the offer of having the job redone or cash settlement. Was pleasantly surprised as I thought they'd make me a derisory offer and I'd have to haggle a bit but got the full lot back, six years after the 'paint' was applied.0

Was pleasantly surprised as I thought they'd make me a derisory offer and I'd have to haggle a bit but got the full lot back, six years after the 'paint' was applied.

No still not had 'final decision' had a phone call from the relationship manager who says she hopes to bring me better news by the end of this week, but final decision goes to their legal people, I've told her that if it's not in my favour I need the 'final decision' letter as I WILL be going to the FOS, I may still go and complain as they, in my opinion, have been trying to fob me off with one excuse after another, hitting me with laws that don't apply etc, to me that's not good and as FOS says in it's guidance, consumers shouldn't have to enter legal arguments, simple facts should be enough.Thanks to all the competition posters.0 -

To be honest, there was no argument at all from them. The surveyor they sent to my house recommended the whole job be redone but I pointed out I'd prefer a cash settlement so they offered to refund the whole amount I'd paid. I'd kept the original pamphlet Aquashield gave me when persuading me to have the coating done, which had all their promises which didn't hold true. That was proof enough that the product had failed. I've still got it if anyone needs it!Thanks to all the competition posters.0

Well done to you !!! that makes two of us at least who have had our money back ! so surely this means everyone should be "in the same boat" so to speak ? I was even more lucky did not even have a surveyor come to the house ! just got a cash settlement right away ! and like yourself had kept all the literature !! even had a photograph of the house with the board up of the Aquashield Duck promoting the product ! ....best of luck to everyone still fighting don't give up ! Still waiting on final decision letter, but this will be with me in the next two weeks, I've spoken to the FOS who have taken note of it, and given me a reference number, as soon as I receive the letter to send it, along with my paperwork to them for them to investigate.
They still insist on the limitations act, even though I'm saying to them that the CCA doesn't have a limit of time on it, nor is it a Court we're in or taking it too, but they don't seem to see it this way.
The FOS were definitely interested in the story, so lets hope for the letter to be in soon, so that I can get it away.Thanks to all the competition posters.0
