  • Hello everyone, there seems to be a lot of misinformation in the threads below. We pursued a claim through Consumer Reclaim for mis-sold solar and they were absolutely fantastic as they covered all of the costs in doing so including a surveyor's report which would have cost us £700. Sure they took their 25% out of our refund but they did everything from start to finish and they covered all of the costs in pursuing the claim and in addition to getting us a full refund we got several thousand pounds in compensation. They are now pursuing an Aquahield claim against Hitachi for us and once again they have obtained all of the evidence required to pursue a claim for both refund and compensation, and the compensation is actually more than the refund. I guess we could have tried to have done it all ourselves but we wouldn't have known where to have started in fighting for compensation in addition to a refund. I am certain that we will end up receiving far more than if we tried to pursue the claim ourselves even after they have taken their fee so why should anybody bother listening to all the threads below when there is a company that will do everything for you from start to finish and ultimately get you more than if you did it yourself?

    Thanks for your comments, and many people do succeed by using a reclaiming company, but many have coped just fine by using knowledge they pick up from on here, and by contacting relevant parties for information on their own, yes you may have thought you saved £700 from the surveyor, but that gets added to the costs in the claim against them, the claims company didn't lose out on any costs plus they would get your 25% PLUS VAT I'm sure, so therefore 30% of what you were awarded, so for every £1000 you were awarded you only got £700, so my maths being correct if you were awarded £5000 you would only have received £3500.

    Just a little update...I contacted both GE and Link. Link basically just replied and said we will await information from GE or yourself. I have received a letter from GE asking me to send copy of the guarantee, order form and state what faults I have encountered with the product. I have sent these off today and stated the main faults being moss regrowth and fading but also said that this product was mis-sold and mis-represented as it has not elimated moss/lichen and has not added value to my home. Will not know of any other defects until I get a roof report. I await their reply and will update.

    I've had an updated letter from GE Money, saying that my complaint of mis-sale and mis-representation of the roof product is time barred as it was signed for in 2008 and the complaint was made in 2013. They are also claiming that any claim under mis-representation is time barred under the Prescription and Limitation(Scotland) Act 1973.
    Where am I going wrong, or are they just being awkward?


    Can anyone shed any light on this one

    I'm thinking this is exactly the same as the PPI scandal, where for complaints for mis-selling over 5/6 years old were first refused because of the age, I'm sure it is time barred 5/6 years AFTER the customer becomes aware of the mis-selling. Would I be correct in this?

  • I had some work done by Aquasheild about 7 years ago and had a letter from a reclaim company.
    The work was satisfactory and I've had no problems . I also used Hitachi finance at zero% .
    Am I still able to claim and if so where do I start as I would like to try and claim it myself if possible ?
    Help greatly appreciated.

    Oh - I did not realise it was a Scottish case.

    I would go to FOS regardless.
