  • Well, this is exactly what I was going to post. I also received the form.

    I'm now struggling to see what Customer Reclaim (from now on referrred to as RC) have actually done, other than ask for a complaint form be sent to me. I was assured that my complaint held very strong grounds, and it was literallly a case of Hitachi agreeing and sorting out payment to fix the ongoing issues with my roof. Obviously this isnt the case, as I now have to detail my complaint in minute detail, along with including copies of two years worth of energy bills (Aquasheild claimed the roof coating would reduce my energy bills by 25% due to the 'thermal shielding' the tile coating provides...HA!!!), estimates/receipts of any work I have had done to solve the problems, photos of any areas showing damage etc etc. To say I feel like a chump is quite the understatement!!

    I'm guessing the letter sent out by RC in June was a load of rubbish, or that Hitachi are now reviewing each case individually, rather than just excepting liability, and settling all the complaints in one go. Needless to say, I am most disappointed with the information sent to me by RC, and have basically accepted that this will never end!!

    I do have one question though. Surely if Hitachi or GE have accepted liability in one case, and made a pay-out (as detailed on this thread in earlier posts), does that not mean that they know the product sold was faulty, and should accept liability for all customers who used the product?
    I agree there. If they have paid out on this, then how can anyone else be different. If we are the one's having to sort out the evidence for this. Then why are Consumer Reclaim wanting a quarter of the money plus VAT ?. Even if I could get Energy statements from months ago. I have had insulation fitted since to twice the recommended depth which has I must say made all the difference. So a true reading on the bills would not show. Or would Hitachi say "Look at the saving on this statement". I have not the time or the will any more to be messed around by this. Dominic Littlewood where are you.
  • So, I got my complaint form filled out last night, and its been posted. Having included 2 years of energy bills, photo's, estimates of the work needed to repair my roof, copies of the original contract/advertising info etc, I feel I have done enough to satisfy the Hitachi complaints department, and hopefully my roof will be repaired and made watertight, but we shall see how much longer this drags out for....
  • I can't help thinking it would have been better to go to FOS months ago.

    AN UPDATE!!!!!!

    Well, its finally happened!! After almost a year, Hitachi have contacted me, and made me an offer. I'm not sure if I'm allowed to discuss it, and I wont say anything until its all well and truely sorted, but needless to say I'm a bit happier than I was a few months ago.

    Only problem is now I have to pay Consumer Reclaim 25% of the offer, for basically forwarding on all the evidence I provided them! If only I'd known I could have sorted all this out myself, as I'm sure I would have been able to. My complaint was pretty watertight, so I couldn't imagine Hitachi arguing with me anymore than they have with Consumer Reclaim.

    Still, you live and learn. Once everything has been sorted I'll post the details of my case (and the conclusion), if I'm allowed to (I believe some other posters on here had their offer subject to a gagging order).

    Had a chat with Consumer Reclaim the other day ad all of a sudden the lady said our 25% fee was 30%. I begged to differ with her and I am waiting to hear back. Thing is ! since I have sent my acceptance form in I can no longer get to talk to the lad who has been handling things for us.
    Anyone else had this ?

    No one can prevent you posting anonymously on a public forum about this.

    Sounds like you urgently need to check the terms of the legally binding contract you signed. Note that you'll also have to pay VAT.

    25% plus VAT at 20% of 25%

    25% × 20% = 5%

    5% + 25% = 30%
  • 5% + 25% = 30%
    That was rather my point...;)
  • Look at FOS case study 122/2. I think we can all make an educated guess as to who this is about.
