Oh but it is. It's clearly breach of contract either way, the question is, how much are you going to get for your troubles. They seem to be playing the sympathy card and frankly, I dont believe the story they are peddling. I think it is much more likely that they have changed their minds and are trying to get out of a binding contract and putting everyone else out while they're at it. I'd be bloody furious myself. I might be tempted to sue the socks off them regardless. If the story proves to be true, you can make a donation to the estate, if not, we all know what was going on dont we.

i can understand, when someone has just found out they only have 8 weeks left of their life to live, that they don't want to spend it packing boxes and moving to a different house- that they might want/need to stay put until they die...and i think this is one of those unusual circumstances, that ,even if YOU COULD pursue them for anything, it would be totally immoral to do so...
sometimes s**t happens, and they by far have gotten the worst end of the stick in this instance...
is there any reason though, why the people you are buying off cannot at least sell to you ,as they have promised, and sort out their own accomodation from here, as really, if you can't move in to your ne house, it is because they would refuse to be put out, rather than the old lady being on her death bed! they have the power to at least make sure you aren't put out by this, and they can suck it up and deal with their part of the situation without making it roll down to you!

It's too late now, the contracts have been rescinded but they weren't moving to rented accommodation. They are elderly after all

The other half decided not to go for that house anyway after the hassle we've had with it.

I know that feeling. We lost a house 4 days before exchange (so not like your issue but close) and to be honest, the whole thing was tainted as you say. In our case, the vendor pulled out (after riding us hard to catch up with the rest of the chain!) with no explanation. Word from the estate agent was that something happened 'over the weekend' and the deal was off. I was fuming. Anyway, turns out that 2 months later the house was back on sale but we had already exchanged on another house so couldnt snap it up. In hindsight, the house was nice but it was in completely the wrong place and we wouldnt have been happy there...so, perhaps for the best after all.

sometimes bad things happen, but it turns out to be the best for you when you look back in hindsight! who knows the reasons, but sad for the lady who is dying....
a 45 yr old family friend, just found out she has but a few months to live, with liver cancer...came out of the blue..a few weeks ago, she knew nothing about it..in a few months, her kiddies will not have a mummy anymore...
    sad situations....

Yes...but IS she dying though...or did they just change their minds. How is this sort of thing determined?

Generally speaking, a terminal diagnosis and a forecast of 2 months to live only happens in soap operas.

One of my closest friends was given a terminal diagnosis of a few months some years ago. She died 6 days after that diagnosis.

I can assure you it was no soap opera.

Putting my hard nosed business hat on, you need to somehow confirm that their tragic story is true. There is an extremely small chance you're being played.

I doubt it, and assuming this is the case, I'd put it down to experience and graciously accept your deposit and costs back.

I do not believe a consultant would have said this.

"You could have at best a few months"
"Average life expectancy for this condition is..."

Medical science is not yet sufficiently accurate to predict life expectancy. Every case is different. Two people with apparantly identical symptoms will respond in different ways to medication, or if untreated will deteriorate at different rates.

Consultants know this. They tend to stress to patients the more optimistic forecast, but they will never be definative.

My Dad died last year, 5 weeks after being first admitted to hospital and 6 days after being officially diagnosed with cancer. After the diagnosis they simply suggested we cherish every day with him.

This particular forum is about House, Buying and Renting. Not for discussing cancer.

I don't know how you do it, but as above, somehow check their tragic story is true, and then move on.

You're right, they didn't give a precise time, much more like those you suggested, I guess I got frustrated by the implication that this was a soap opera and this comment too.

Of course, it may be a lie that they are using as an excuse but I find the assumption that it is a sad refection. As has been posted, s**t happens sometimes. I wouldn't be comfortable suing a dying woman and her husband. It would appear some are.
