I think this is just plain wrong....If I've run a car for 9 years then there is no part of the car (service or non service items) that I could complain about if it failed.

If I buy a 9 year old car from a dealer then SoG give me rights with regard to quality & durability. Obviously these are going to vary depending on circumstances cost etc but pretty much any car should make it through the first week without bits falling off

You can think what you like, but its how it is - a dealer doesnt magically wave a wand at a 9 year old car and everything becomes as new. Neither are they responsible by law for issues you could deem to be 'normal wear and tear'. Now the dealer may well put a 'warranty' on the car for a period of time, but this is very different from 'warranting the condition of the car' which is their legal obligation under the SOGA and if you were to read the SOGA it refers to 'faults', which are very different from wear and tear issues.

Also, the O/P has subsequently told us the exhaust DIDNT fall off, but it appears to have been hanging low, suggesting its just a rubber joint has failed.

If the O/P wants the trader to have a look at it with a view to fixing it - which the trader may well fix - then they need to take it back to him in the first instance. Taking the car to have it repaired elsewhere - and no doubt rack up a large, unnecessary bill given shes talking about going to KWIKFIT, will leave the dealer under no obligation to resolve.

Personaly, if i was the dealer i would certainly be getting it sorted, however, there is a clear distinction between a 'fault' and wear and tear on a 9 year old car.

Hi thanks for your comments. Back from Kwik Fit. They advised the 4 Rubber clips have work and broken. One hanging in there has helped it from dropping off completely.
Now it's only going to be £30 to fix but my worry is the car was MOT'd for sale and Kwik fit have suggested it should never have passed like this so my worry is what else should it not have passed on!?
Should I be contacting who I bought it from or the garage who done the MOT for it?

I wouldnt get too concerned. Chances are one broke first and then the weight of the exhaust snapped the others.

You've got away very light with KWIKFIT by the way - they normally see £££ signs when they get a customer in.

    £30 for some rubber clips ;) ?

If you think the MOT is dodgy you can report it to VOSA but if the car seems ok then I'd be inclined not to worry, especially as Kf haven't told you it needs a full restoration.

Mind, if you are looking for a reliable car that won't give you any issues an aging Renault is not necessarily the first place to look...
What if there was no such thing as a rhetorical question?

You sound like my husband! Lol As its the 3rd in 2 years I'm inclined to agree but it's a great family runaround. Cheap to run (untill they break that is!)

Think I should just get a full service sorted ASAP and hope for the best!?

I bet the trader is happy that you happened to find your way to his door!

I don't expect it to be perfect but road safe would have been nice!

Obviously you wasn't taught if you have nothing nice/constructive to say, don't say anything at all?!

    Here's a solution, don't read these threads...

In regards to the actual thread here, OP, what motorguy has said is basically what needs to happen, although the exhaust may not be held under the dealer warranty, as you've only had it a week I fail to see any form of driving that will cause this damage (whether it be wear and tear or a fault) and if KF are quoting £30, he'll probably have some stuff lying around that will sort it.

If it passed MOT then i'd be confident this is just a one off, an exhaust hanging off isn't the end of the world, it would be different if it was one of your doors or the brake discs ;)
