Deposit for second hand car but now won't start?

    So the car has gone from "now won't start" to "I wouldn't have it to drive for the forseable" to "make me wait weeks rather than days to get me a working car"

    Like I said in my first post, I think you're just having second thoughts about buying the car and are looking for any excuse to get out of the deal.

    Again I Want the Car but I need a car NOW any car I don't really care as long as it works. I'm not trying to get out of anything.

    My original post was weather I was entitled to a refund as its not drivable. If it became drivable today Fantastic but wanted to know if they could make me buy the car or keep my deposit with it not working and how long was reasonable to wait.

    I was told it was being looked at straight away. Now it's being looked at today I could just be getting fobbed off for all I know!?

    But no I'm not willing/able to wait I NEED a car! I live in a rural location I am unable to get to the shops, play groups, doctors etc until its resolved.

    Maybe you should wait until July 1st. You wont lose out on the tax then ;)

    Great in theory but I'm desperate for my freedom back ASAP

    My other problem is I only have 9 more days to transfer a car onto my insurance policy or they cancel it.

    They car will likely have some new parts fitted, So your getting a better deal. Dont forget about that.

    Following on from this I got the car last Tuesday (happy Days)

    last night the exhaust fell off!! Unhappy! Has brand new MOT. Now where do I stand? Do I go back to them or do I just need to suck it up and get it fixed myself??

    Tell us more about the car - age, miles, price paid, etc, etc.

    The exhaust falling off a £30,000 car is a different issue than the exhaust falling off a £500 car.

    Chances are its a bracket has broken, and taken the rest of the worn ones with it over time to the point they all broke.

    Could cost a few pounds to put back on.

    Did you not notice the exhaust rattling?

    It's only a 04 scenic. Altho I don't see how my rights are any dif dependant on car/ price etc?

    No car was running fine. Bit noisy i put it down to being a diesel tbh. I've only driven it about 100miles max. Came home last night and it was sounding Strange. louder than previously. My husband happened to be following and he noticed it was bouncing around.

    I've booked it into Kwik fit but want to know if its covered by SOGA 1st? Should it have been picked up on its MOT?

    Your rights vary because you have to factor in wear and tear. You have to look at it like this 'if i had owned the car from new, would it be reasonable to expect the exhaust bracket to need replacing at 9 years old?' if the answer is yes, then its wear and tear. If the answer is no, then you have to ask is it a fault with the part? THATS what the trader must cover - faults - not wear and tear. Is it likely to be a manufacturing fault that caused an exhaust part to give way after 9 years, and the answer is clearly no.

    DONT TAKE IT TO KWIKFIT - they will tell you you need a new exhaust, your discs are all dangerously low and your pads are at their limits.

    Find a small independent exhaust repair specialist and get them to have a look.

    IF you expect the dealer to fix it though, you need to give them the opportunity to do so first. You cant take the car elsewhere and expect them to foot the bill.

    Possibly should have been picked up at MOT, but not unlikely that it wouldnt have been.

    Also, you told us initially the exhaust had fallen off - what your describing now sounds like a mounting has just broke and its hanging low?

    I think this is just plain wrong....If I've run a car for 9 years then there is no part of the car (service or non service items) that I could complain about if it failed.

    If I buy a 9 year old car from a dealer then SoG give me rights with regard to quality & durability. Obviously these are going to vary depending on circumstances cost etc but pretty much any car should make it through the first week without bits falling off
