Deposit for second hand car but now won't start?

Hi I put a small deposit and tax money down on a second hand car with a private dealer at the weekend. It needed taxing and a few bits doing and was to be delivered today.

I've had a call to say the car now won't start and they are taking it to a garage. Where do I stand with this now?

    There is no such thing as a 'private dealer' - I think you mean this is a private sale. I would wait to see what the outcome id of the inspection by the garage.

    When you say 'private dealer', what exactly do you meant? Is it someone trading from home as a business?

    In any event, I would ask for my deposit back.

    Someone trading from a home. They had several cars and was able to take me for a test with dealer plates and get it taxed etc?

    It's covered under the SOGA then. You are entitled to demand a refund of your deposit if you so choose.

    Where what is? The fact that the OP is dealing with a person selling cars from home?

    I may be wrong but I was under the assumption SOGA kicks in when you have received the item (car). If it breaks down when you are in receipt, then there's a problem and you can claim a refund.

    As it's broken down before you have the car, why not just let the seller fix it? It could be something simple or maybe it's the alternator so you end up with a new one in your car. Without more info you could be better or worse off.

    I purchased a car from a dealer on Saturday, paid the deposit a week ago and pointed out the air con didn't work at the time. Went to collect it Saturday, dealer said the aircon was a cracked pipe, fixed it and re-gassed it working fine. Then he said the aircon guy noticed a slight leak on the radiator, so the dealer decided to have a brand new radiator fitted to the car so I wouldn't have any problems after purchase.
  • I once bought a Volvo 740, which when I wanted to test drive it wouldn't start. The dealer brought it round to my house the next day, and I bought it. It was one of the most reliable cars I have ever owned, and I ran it for about five years.

    Not starting is usually a VERY easy fix, and is no reason to turn down a car. It could even be down to no petrol in the tank!
