On to the next one then.

If they have deleted the orders from their database then they are in contravention of the data protection at.

one of the 7 principles is that information held must be correct, current and held for 7 years with regards to personal data.

E.g. Name and Address.

By deleting the order they have deleted your personal data and in my understanding (*Disclaimer I am not a lawyer).

They have contravened the DPA 1998 deleting that information that if you approached the Data Protection Registra and paid your £10 they will need to be able to provide that data to you.
DPA says: data should be ‘adequate, relevant and not excessive’ [1]. ‘accurate and, where necessary, kept up to date’[2] Data controllers can also not hold the data for longer than ‘the specified purposes[3]’
[1] The Data Protection Act 1998 (DPA 1998) Schedule 1; Part 1; Principle 3

[2] The Data Protection Act 1998 (DPA 1998) Schedule 1; Part 1; Principle 4

[3] The Data Protection Act 1998 (DPA 1998) Schedule 1; Part 1; Principle 5

they are not allowed to keep the data for more than the specific reason, ie your order, if they delete your order the reason no longer exists for them to keep your data

The crucial information is missing though , you need to know what price are they going to charge you ?

This is really a very grey area at the moment , I have a feeling they will charge the full price regardless of what the order says .

People are overlooking one basic point of contract law. In order for there to be a contract there has to be consideration on both sides. i.e. you have to pay. Without payment (or arguably at least a promise to pay a tangible amount) there is no contract.

If anyone added any accessories etc. to the order then the fact that the hoover cost £0 would nevertheless mean there is a contract for the order as a whole.
• I called up their customer service
Cs: Hello
Me: I placed an order just wanna check the status of it
Cs give me ur details(including model number)
I gave details
CS shall I put ypu on hold?
me OK
bang (phone disconnected)

I tried again always at waiting list 1 but as soon as someone picked bang(
DC)

Finally spoke to CS again.
ME: I spoke to another Cs and she put me on hold but call get DC. I wanna check the status please.
Cs give me ur details (including model number)
I gave them
Cs I am not able to find your details are you sure about ur post code?
Me yes
CS: how did you placed the order? as we dont have in our system.
Me: are you sure you don't have it? as I have screen print as well order number along with a mail from you
CS: there is a power failure and I am not able to access your details sorry.
ME: Power failure?
Cs: yes power failure. Can you try after an hour?
Me (laughed out loudly so Cs should hear and understand that she made a childish mistake and should not repeat in another call) OK.

Whatever they are upto I am sure their Cs is not at all upto mark.
I was wondering what will be after sales service?
they need good managers. who will stand and admit that they made a mistake and apologies for inconvenience.
TBeckett100,
I recd your mail ID will send the screen print along with my order number.
My only concern is that it has my personal details.
Hope it will be in safe hands
