Buying a house that has tenants in it

He has already said he is happy to do things `not as quickly as he should` ?
It`s not a case of bashing him for something 6 pages ago , its a point of view that he appears very lax with things that ARE within his control
FYI, I'm keeping the buyer up to date via the EA. When I bought the flat in Dec '09 I was a first time buyer with an IFA and no trouble getting a mortgage - it still took me 4 months. I'm keeping gentle pressure on my buyer's EAs (they're understandably keen to get things sorted ASAP), regularly checking my own NEW conveyancers are on the case (which they are, very efficient - I fired the old ones for being useless), my own EAs are dealing with MY buyer and I keep them up to date so they can let him know how things are going. I'm hoping we can get a date pencilled in for early August, but any sale/purchase is fraught with issues.
Not much more I can do except make sure all involved are on the case, is there?0 -

They may be straight-forward to resolve until the very moment the vendors answer "no" or fail to come up with the information or documentation requested of them.
I'm not a conveyancing solicitor so do not know whether some questions are irrelevant or other rather pertinent questions have not been asked. I know who I'd be asking.......0 -

These are the questions my conveyancer has put to the seller's solicitors so it's all being handled by the appropriate people. However, I've never bought a freehold before so thought it a good idea to ask if anyone had anything to add - doesn't seem so, which is good.0 -

I would not say COMPLETELY worthless. It does, at least, mean that the tenants are aware the house is being sold. It doesn't mean they intend to move out, for sure. However, they have been to the EA looking for a new home which means that they SEEM to be resigned to moving. Again, no guarantee, but so far I have no reason to think they won't be moving out, just the concern that they might not.0 -
Exciting news!
I've spoken to the EA. He's seen a copy of the notice sent to the tenants and they have to leave by 10th August. I said I wanted to inspect the property before exchange, he said we should pencil in the 12th as the date for exchange.
I've emailed my conveyancer to suggest this to her, and have told my own EAs to pass this on to my buyer.
Let's see how that pans out.0 -
EXACTLY what has your EA? A copy of a S21 notice or a copy of a possession order?
I know, it doesn't amount to anything legally, but so far they've played straight with me so I'm going to think it most likely that this is a realistic time-frame.
There's nothing more I can do.
My conveyancer is waiting for confirmation of this from the seller's solicitors so until then this is all up in the air, I know.0 -
OK. This may be a section 21 notice.
All that does is ask the tenants to move out.
If the EA thinks that this means that the tenant has to leave by August 10 they are either a muppet or stringing you along.
The Section 21 could be invalid (deposit not protected properly and prescribed information given, dates wrong, etc etc.)
If the LL managed to get it right (some who seek advice here manage to do it wrong twice and get it right third time) and the tenants decline to move out, then the LL has to get a court date.
Once it gets to court the LL has to get a possesion order and then they have to enforce it.
COuld be anything up to 5 months so you could be in for Christmas.If you've have not made a mistake, you've made nothing0
