Samsung Galaxy S3 Warranty is not transferable if bought 2nd hand

as the title suggests i have just purchased a second hand samsung galaxy s3 from a reputable online store (i have dealt with them in past buying apple products with no problem)

a 60 day no quibble warranty comes with them which is fair

however i wanted to check how much original samsung warranty was left on the S3, i phoned samsung and gave them the serial number , they were able to tell me it was made on the 1st december 2012 and has a 2 year warranty but would need me to tell them the date the phone was originally purchased.

once i explained i was not the original purchaser and neither i would say was the store i got it from ,they said that unless you were the original purchaser then the warranty was not transferable.

surely this cannot be right!!! i argued until i was blue in the face but this is the way it is.

is this fair and legal????? basically after 2 months now , my S3 will have no warranty at all even though it does have 18 months left??

can anybody shed a bit of light on this:mad:

    i was also told this but in other threads posted here people have sent off second hand phones and had them fixed by them so i dont know whats correct

    Did you get a copy of the warranty document? If so it should say if it can be transferred or not and under which terms.

    Manufacturers can limit their warranty in any way they wish, but your statutory rights are protected. However, you have no contract with Samsung and they have no obligation to you. Your contract is with the seller and only they have any obligation to you. Samsung are not involved.

    You have bought a used product with a 60 day warranty. Accrding to SOGA, the goods must be fit for purpose and of satisfactory quality. If it breaks after 2 months, you would have to argue with the seller that the phone does not meet those criteria, not with Samsung.

    You shouldn't have told them it wasn't bought new.

    Samsungs 24 month warranty is a limited extra warranty over and above the original vendors warranty .

    New phone one year warranty from the vendor under uk law . That is not warranty from Samsung unless they are the vendor .

    yep i should have lied my !!! off. honesty it seems is not always the best policy.

    How come that with Apple the warranty is transferable with no fuss (apart from them damn liquid sensors which go pink if you even say the word "water" near them )

    Guess that due to the very high profit margin Apple can afford to be a lot more generous .

    Well if that's the case then all that is needed is original proof of purchase and proof that it was sold to the OP. So long as this is supplied SAmsung can be compelled to perform its obligations or be liable in damages for the cost of repair.
