PPC Court Claims 2012: The results are in!

Don't forget that people might also go to see a solicitor when they receive an MCOL claim. My guess it that most PPC's would run a mile from a well prepared defence by a good contract law/commercial law solicitor.0

That's unlikely to happen. The average high street solicitors are fairly clueless about this sort of thing, and any specialist motoring law / contract law solicitor will most likely charge more than the amount of claim for preparing a defence.Don't forget that people might also go to see a solicitor when they receive an MCOL claim. I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
It's a small claim most will not go for a solicitor as their costs will be more than the claim itself, so unless someone is doing it for themselves as a solicitor or for mate for free then they won't I should imagine bother, though your legal cover through your house insurance might do it??
I think most PPCs will run a mile when they get the defence that has been done by the guys over on pepipooWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

My thought is: Would the 'average' guy in the street fully understand the pepipoo given defense 'he/she' is presenting to the court? Or would they not need to?Got a ticket from ParkingEye? Seek advice by clicking here: Private Parking forum on MoneySavingExpert.:j0 -
I always tell them "Read it all the way through, and make sure you understand it, you may have to make these arguments to a Judge".My thought is: Would the 'average' guy in the street fully understand the pepipoo given defense 'he/she' is presenting to the court? Or would they not need to?
But I doubt if many of them do, fortunately these cases hardly ever end up in court.

I have a copy of it and it's not rocket science.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Can your clearify what you are saying?
Are you suggesting that people getting a CCJ against them will just ignore it?
If a PPC manages to get a CCJ against someone I can't see them not chasing it up.
Actually this is exactly what i am saying
Many people just ignore CCJ's and nothing is done about them simply because the cost of trying to enforce them is out weighed by the chances of actually seeing your money again
People "lets take him to court to get the money that he owes us", but you do that they just ignore it and then if they are not working or you cant find out where he works, then you will face huge problems getting anything back.
Its not just simply a case of getting the judgement enforced through a court baliff. As they may visit a property but the person with the ccjs owes nothing in the house of any value, or they have just moved.
It may look good to have won lots of cases but what % have paid you a penny.
I have a close friend who racked up over 65k in debt and about 20k of that resulted in CCj
He has never paid a penny of them and the companies have given up chasing. One of these judgements was from a window company where he got the whole house double glazed, didn't pay , then went under oral examination, agreed to pay a £1 per week after telling judge he had no money and the window firm has never seen a penny
It isnt the golden egg more like the curates egg....Proud to be a member of the Anti Enforcement Hobbyist Gang.:D:T0
