This boy used a weapon to injure your daughter. Regardless of what your daughter did, this is not acceptable and I would report it to the police before anyone else is injured.
On another note, I would also be having words with your daughter about treating people as she would wish to be treated.

Yes to the former and thats already been discussed with her last night. As to the latter I just knew someone would play the race card eventually. I find your demonstrated intolerance breathtaking. Did I say that it was her that made the comment? I don't personally care if his skin tone is white, black, green or sky-blue pink. Or is it OK to carry around a BB gun and be prepared to use it just in case someone makes a "racist" comment?
Its getting properly to the bottom of it that I want to do but it sounds thus far like no more than general skylarking to begin with. Am still not entirely sure that the BIB tramping all over in size 15s it is going to be conducive right atm.

keystone I suggest you take what you feel might help from the thread and ignore any posts that you feel are not accurate to the situation or simply don't help.
You are the only person who knows your daughter and will have the most accurate take on all of this.
Threads like these attract varied opinion. There's really no mileage in getting into 'discussion' about certain aspects. It wont help the situation so why bother.

Just wanted to say that I would be upfront with the police about all the information you have about the incident. I would also emphasise that obviously both your daughter and the boy are young people with futures ahead of them and your primary concern is that no-one should be injured in the future.
Call me naive, but I would hope the police would exercise good judgement in finding a solution that would achieve these goals.

If it was a "boy" ie. under 18 then someone is likely committing an offence under the Crime and Security Act (2010) by allowing it to be in his possession.
If the gun looked real then this is also an offence if displayed in a public place.
It is obviously an offence to fire it at someone causing injury and although rare even weak bb guns have caused death before.
So yes, I'd go to the police. He's carrying around his gun for a reason. Nobody needs to be carrying around a bb gun, and certainly no child.0 -
Apparently she was "dared" to "borrow" his scooter which she did and then returned it and then for a second time.
Apparently there was also some comment when he produced the thing along the lines of "so you'll make a good terrorist one day".
An added complication is that (how can I put this in a way that I don't generate offence?) he doesn't have a particularly English sounding name. The two groups (3 or 4 in each, one girls the other boys but all from the same year at the same School) were quite separate until a few minutes before this event occured. I don't believe he was being "picked on" wholesale. Of course there are always two sides to a story.
I'd be reporting the incident to the police. If he has a gun in public he could either end up hurting someone much more seriously or he could be at risk himself if someone reports the gun and the armed response team turn up.
I would also be making it very clear to my daughter that I was unhappy with her behaviour. If you end up being the one "dared" to do things it's usually because the others realise it's not a good thing to do but that you are mug enough to be coerced into doing it. Doing it twice is even more stupid!0 -
I'm assuming that the BB gun is more than 50% brightly coloured.
I don't think you can buy them now unless they are 50% bright orange, blue, etc.
It makes them more obvious in regards to "realness".
A Plastic BB shot at 20 feet could easily have been aimed quite "off" to scare someone and then hit them.
They are quite readily wind affected.
It shouldn't be aimed at a person (or anywhere near) but at 13 judgement isn't going to be exactly superb.
My opinion is that whoever supplied the BB gun is the route cause of problem.
Really it should be sorted between reasonable adults as both parties appear to be at some level of fault.
A sensible police officer to put the "frightners" on also wouldn't go amiss.
However, i suspect involving the police could end up in a massive mess for all parties.
Personally i'd speak to the school, see if you can get a feel for the family of the BB owner and if they are normally reasonable people i'd try get it sorted via that route.0 -
About ten years ago I called the police after being shot at by two guys with an air rifle, they thought I did'nt know where they were hiding. Within minutes an armed response unit turned up with officers carrying loaded guns, real guns..
I gave evidence at court, turned out one girl had been shot in the face and others hit. These were adults in their late twenties discharging an air gun in public, at members of the public.
They both got six months in prison.
The police need to be told about this kid, he will get a scare and hopefully not go on to worse things0 -
