Devere parking services ltd

Hi guys, I hope this is the right place and some of you can help me.

Today I found a "parking charge notice" on my car from "Devere parking services LTD".

After a quick google of the company name I found various people have been having problems with this company and some suggesting they aren't even legitimate.

Putting things basically the fine is for parking, in my own designated parking space outside my flat, but not displaying my permit (which I do own and have for years).

To throw a curveball into the mix, the date on the fine is the 5th but today is the first i have seen of it. I can upload any pictures if necessary.

    With Devere its best not to post any further details, see my signature below. Are you the lease owner of the apartment and parking spot ?
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    What does your lease say about the parking space? If your lease specified the nunbered parking space as yours, then (unless it says otherwise, which is unlikely) no-one has the right to impose additional conditions on it, such as displaying permits or slapping invoices on your car. Tell them to go to hell (and the management company, too, who no doubt unilaterally imposed this system).

    When dealing with "tickets" from private parking companies (PPCs) our advice is either:

    1) Ignore all communications if you are the registered keeper (other than in the extremely unlikely event that you receive genuine court papers - there were only 49 cases going to court last year out of over one million tickets issued); or

    2) In England and Wales only, and if the PPC is a member of the BPA AOS scheme (which Devere is), appeal to the PPC but ONLY once you receive the first letter (Notice to Keeper/Owner). Then when rejected, appeal to the independent Parking on Private Land Appeals (POPLA) service. If the appeal is unsuccessful then ignore subsequent correspondence from the PPC except for real Court papers.


    The important things are:

    - if the vehicle is lease/hire/company car then 2) is the recommended option as you'd be mad to ignore it then see a stupid lease co. panic, pay and then charge you.

    - if you decide to ignore please don't panic about the debt recovery letters. File them all in a drawer marked 'scam' like thousand of law-abiding people have done for many years. Only take seriously real sealed Court papers if a PPC tries a small claim. This would be a letter from Northampton Central Court - defendable BUT...

    TROUBLE IS, DEVERE ARE NOTORIOUSLY ONE THAT DOES TRY SMALL CLAIMS AND IF YOU ARE IN BOURNEMOUTH/POOLE THEN BE WARNED THAT THEY HAVE STRANGE 'FORM' FOR WINNING WITH THAT COURT...ODD 'CONNECTION' BIAS POSSIBLY, I THINK THE OWNER OF DEVERE WAS ONCE A MAGISTRATE?

    If you decide to challenge the fake PCN (which I WOULD with Devere), just wait for the Notice to Keeper/Owner to arrive, then get help here first with your appeal wording, particularly important before wasting a perfectly good POPLA code which SHOULD mean you can win.

    As an overview of what sort of advice people are given about challenging these fake PCNs, you should be reading any threads here as all the scammers are the same - except that Devere can be a bit litigious. Hence why you should look to get this cancelled at POPLA, not ignore it.

    As part of your challenge you'd be looking for breaches of the BPA code of practice and demanding lots of evidence. If you want to start with a strong legal challenge to Devere then adapt and use parts of this template from the Parking Cowboys' website which you will see has lots of points:

    ...and check out their summary of what a PPC has to do in order to be enabled to pursue a registered keeper rather than a driver.

    But if this was a windscreen fake PCN, just WAIT for the Notice to Keeper to arrive in the post before doing anything in reply - unless the PCN has arrived by post already. In the meantime do get pictures of the signs (and lack of signs) and dig out your lease or tenancy agreement to see whether it grants you rights to park anyway.

    Do reply and tell us when you get the first letter please, and what it says and what the dates are between the incident and the Notice in the post.

    With DeVere, I would not advise ignoring, they do take people to court, and if you live in the Bournemouth/Poole area you may find yourself in front of a Judge who has some kind of connection to the company.

    Wait until you get the Notice to Keeper, then fire off an appeal - you can find a good template for this on the Parking Cowboys website.

    If DeVere reject your appeal, they must give you a code to appeal to POPLA, and over at Pepipoo there are plenty of people who can word that appeal in a way that will almost certainly succeed.

    I must admit I was a bit nervous about ignoring them as I heard about several court cases which Devere usually won.

    If I pay within 2 weeks I'll be paying a "reduced amount", if I appeal and it fails will I have to pay the full fine?

    I do appreciate all the help guys, especially when you are spelling things out to me.

    If you appeal and actually lose at POPLA then no, the decision is not binding on you. In fact I would go as far as to say that POPLA is a better bet for you (with our help to word the challenge) than to ignore, as this is Devere and if your local Court is Bournemouth/Poole...

    So let us know when you get the Notice to Keeper (NTK). Keep all envelopes of all letters, things like dates posted can be important, if different than dates on Notices.

    So what? You won't be paying anyone anything. You have parked in YOUR OWN parking space. No-one can penalise you for so doing. And IT'S NOT A FINE.
