When composing statements to present in court.
Is it permissable to use bold type to emphasise a point or is it NO NO.0 -
I know, my point is something should be awarded, particularly if the defendant has been obstructive or procrastinatingCentipede100 wrote: »You don't get your printing & postage costs back following a judgment in your favour. If you're new. read The FAQ and Vauban's Guide

I have a lot of sympathy with this view too. It takes time, money and some guts to take an airline to court: and this is precisely why only a small faction do so. The airlines rely on this, knowing that - however poor the legal justification - it makes economic sense to them to waste everyone's time in this way. There ought to be a sanction, in my view, for such a frivolous refusal to settle legitimate cases.0

My hearing is on the 30th May. I'm in Scotland going through the small claims in a Sherriff Court. I have not been asked to provide any court bundle two weeks before the hearing.
I intend to take with me copies of Wallentin and Finnair as well as 261/2004. I will also have a witness statement laying out my claim and rebutting the defence. I'll take all correspondence too.
Anything else I've missed?"Sometimes life sucks....but the alternative is unacceptable."0 -

Can the amount be different than the original claim then? Mine is a bit confusing as I have already been paid for one leg of my flight but didn't have interest or further court fees on.. Can I do a new amount on ,my witness statement? Thanks
No, your claim is stated in your claim form and in your particulars of claim. CPR rule 16.4(1)(b) and (2) require you to state in the particulars of claim that you are seeking interest, and if you missed that out then technically you cannot claim any. Court fees don't need to be claimed though as they are awarded to the winner as a matter of course. You would be unable to use your witness statement to make any kind of claim.0 -
I'm surprised this isn't a more active thread!
In my bundle, I would like to ask some questions of the airline. I've seen posters saying they "put the defendant to strict proof ..." or siumilar.
Could anyone tell me where would this go in the bundle?
Thanks!0
