    When, if in Court you can start off by introducing the amount of your claim and if the Defendant objects then that is the time for him to do so.

    So if interest wan't on my initial claim, can I add it now along with the additional court fees?

    Yes, insofar as I am aware ie 8% from the date of delay until the date of the hearing however be prepared for a 'knock back' in Court as the 8% level reflects returns in the market when the MCOL was established. In my case the Defendant argued that 3% was more appropriate however my stance was that 8% was the minimum I would accept based upon all the recorded delivery, copying, binding etc I had to do.

    Okay so Court bundle sent to Court Rec Delivery, 2 weeks before hearing.
    Question - doi I have to send the bundle to Airline's legal firm 2 weeks before, or can it be sent last minute, like they do with everything? :)

    Well i posted it at same time to solicitors as they previousley sent a letter saying all correspondance to go to them.
    I suppose the sooner they get it, they sooner they might accrpt defeat and pay up beofre court date... :)

    Does any one know if Thomsons use their own legal team in court or appoint local solicitors etc.

    When calculating interest do you include the out of pocket expenses at the airport, postage telephone calls printing documents etc.on top of the compensation for delay.

    No not allowable however you may wish to make a brief note and if you do go to Court and things go your way you can 'try your luck' as the Judge may be as fed up with the airline as you are :)

    Given that I paid £15 in postage to send court bundles to Court and solicitors alone, I don't think £50 awarded by judge would be unreasonable....
