Paradigm - There's no reason why the Dad shouldn't pay, I think the point others have been making is that with families there's more to consider than the single damage transaction. e.g. if the Son is getting free food & lodgings then it could end up in a tit for tat, Dad pays for the car scratch, but charges the Son for food & lodgings, where does it end?

I must be missing the point here.

I have 2 kids living at home, both pay board. This board isn't anywhere near what they would pay if they were living on their own... I thought that was what parents did for their kids????

Now if I damaged my sons car I would be offering to pay for the repair, not using his cheap "rent" as a getout or a bargaining point!

If you were my kid you can guarantee that you would have needed Childline on speed dial you cheeky ungrateful !!!!!!.
Sometime in the future you will be looking back on this wishing he was still there to scratch your car again and you will definately be playing it differently in your mind.

    Smells like troll to me.

Where are the Billy Goats Gruff when you need them?

When my dad used to have little dings in his car, I used to repair and spray them, and if he had done it to mine then I would have done the same (I may have made a few sarky comments though).
I would never have considered doing what the OP is suggesting.
I suggest that the OP learns a new, valuable "lifeskill" - how to use aerosol spray cans - it will save you money in the future.

Oh yes, nearly forgot. Your dad is worth a lot more than the sports car that you saved up for. I wonder how many times you took him out for a beer whilst you were saving up for it?

[...] if you believe the first port of call to resolve the issue is to ask on a public forum what potential action you could take against him then it doesn't bode well for your future career in Law.

^^^ Fixed that for you ;)

Honestly, there are basically 3 approaches. You can:

    (1) As (sensibly) suggested earlier, put it down to one of those things and move on.

    (2) Find out the cost and speak to him about it.

    (3) Go the full litigation route, not forgetting the emotional distress that seeing your hard-worked-for car ruined like this has caused you.

    (4) Go mental on his !!! with a baseball bat and plead insanity at the subsequent trial.

Which you do is entirely your choice, but the fact that you felt the need to ask here rather than working those fairly simple choices out for yourself really doesn't instill confidence for a legal career.

Yup. The Parkinsons was the giveaway. Too neat.

My answer to the question, though, would be as follows:

If I were the father, I would have insisted on fixing it, without being asked. If I were the son, I wouldn't have dreamed of asking.
If someone is nice to you but rude to the waiter, they are not a nice person.

Not particularly funny considering the reason I don't get on well with him. He should be in prison by all rights for some of the stuff he did to me and my sister as kids. He's very lucky my sister in particular is very forgiving. Just for the record no I am not a troll. Everyone is a bloody troll according to some people on this site.

Yet you still choose to live in his house when term's ended, presumably because it's convenient and / or cheaper than having your own place. Personally, with the background you're hinting at I'd be living in a gutter rather than doing that.

Sounds like you should be happy it's only the car he's touched, huh?
