    Thanks so much, I really do appreciate your words of advice, I like the suggestion of an offer including wording of "if they reject that they must send the rejection and popla code by day 35 of the original appeal. " Feel inclined to do this. I used the wording Stoma suggested last time so lets see what happens. I always sleep on problems so I will do the letter tomorrow. Thank you all for your help I have been visiting the other sites and will go and register on them tomorrow. Kind regards

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Had the non-payment of the parking fee been as a result of your oversight, for example, then I would endorse the inclusion of the offer of an amount to cover their admin costs. As it is, the situation is entirely of CEL's making and their ramping up of the issue with a complete disregard for the facts is their problem. As I have explained above a potential claimant has a duty to minimise their own losses and CEL's actions demonstrate the contrary.

    I suggest that you offer the parking fee and explain that your exclusion of an allowance for admin is because the situation was created by their inefficient/deficient systems.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Is this better ? I am slightly nervous about not offering an admin fee, partly because I am conciliatory by nature, and because their argument could be that I should have driven away and not used the parking facility?

HadI overlooked or not attempted to make proper payment I would of course paid you’reyour penalty/administration fee but this situation was created purely because of aninefficient or deficient system.


    I enclose a cheque for £1.50 as finalsettlement.

    I would clarify your 'no further information'.

    I have no further information to provide and will not be contacting you again. For the avoidance of doubt, this means that if your Manager Review fails to uphold my appeal you must automatically enter this for your Customer Service Director review, and if that fails, you must send me a valid POPLA code. As per the BPA guidelines, this must be completed within 35 days of my initial appeal.

    Our appeals process (which must be followed in step by step order) is as follows:-


    1. Your appeal should be sent to us in writing within 28 days of receiving your ticket. The address to send your appeal to is printed on all of our tickets.

    2. We will respond to your appeal within 14 days of receiving it. If at first we only acknowledge the challenge, we will write to you again within 35 days accepting or rejecting your appeal.

    3. If you are unhappy with our response you may ask us to send you the form for a ‘Manager Review’. This will provide you with the opportunity to have your appeal and our initial response reviewed by our Appeals Manager.

    4. We will respond to your Manager Review application within 14 days of receiving it. If at first we only acknowledge the Manager Review application, we will write to you again within 35 days with the full Manager Review response.

    5. If you are still unhappy with our response you may write to our Customer Service Director for a final review off the matter.

    6. Our Customer Service Director will respond with our final review of your application within 14 days of receiving it. If at first we only acknowledge the Customer Service Director review application, we will write to you again within 35 days accepting or rejecting your appeal.

    7. If our Customer Service Director makes the decision to reject your appeal, this will be our final position on the matter. With any such rejection we will send you the details of Parking on Private Land Appeals (POPLA) – the Independent Appeals Service. If you use the POPLA Service, and your Appeal is unsuccessful, the full Parking Charge will apply and you will not be able to pay at the reduced rate.
