To get the phone to work on O2 it will need to be unlocked, and you have 2 options, the person who's name the contract was in can get it unlocked off Orange for £20 when the contract expires, reading through your posts it seems your ex is unlikely to do this, now the bad news, Apple have blocked the free way to unlock this phone, and the oly way it can be done now is by getting it unlocked at a shop, the even worse news is Orange locked iphones are the most expensive to unlock and it will cost around £1000

If the phone he is using is your phone from your upgrade, then you should contact your network to get that handset locked out? leaves him with an expensive paperweight..
O2 should have the original IMEI details from the Iphone 5 upgrade..
