Sunday Express Star Trek Tshirt Offer basically lies

Options
Hi everyone, just felt like venting about the offer in todays Sunday Express. I specifically bought one for the offer but when I got to the only WH Smith open in my city today they informed me they had only received 4 tshirts!

I just find it so annoying that they are able to get out of it by saying on their t&c's 'subject to availability' when they supplied only 4. I would have thought city centre branches would receive maybe 100 while ones in town centres would get maybe 50-75?

Has anyone else tried to redeem this offer and been let down?

TBH I have been let down by their offers time and time again, unless it's been for an item that the store would normally hold in stock; special items such as gardening gloves, were never received by the store at all.

I don't understand how they are allowed to do this-is it not false advertising?

They cover their backs with phrases like 'subject to availability'.

It's not false advertising, no, but a look at sales for previous weeks would tell give them a fair idea how many to expect this week and they could provide a proportional number of t-shirts. With only 4 going to your store I don't think they've done that.

Hmmm isnt a requirement for offers like this that they have adequate stock to meet demand taking into account the price vs whats on offer, and the scale of the advertising?

For example a local store doing a promo of buying a book and getting the no 1 bestseller free, probably isnt going to have huge demand. A national paper advertising something which is likely classed as a collectible, especially one from Star Trek which has a HUGE fan base.....the only way i'd expect 4 t-shirts to be sent is if they only sold 1 paper locally (because the purpose of the free item is to sell more papers - not less).

Might be worth a complaint to ASA/TS. Not that it will probably get the OP his t-shirt, but it may be enough for them to get a telling off (or perhaps fined if they're repeat offenders).
