    It has had a lovely sense of "in the same boat" community right from the small beginnings when we all possibly didn't know what we were doing and trying to work it all out. Receiving curved balls such as the 2 year limitation letter and all sitting about waiting for appeals to be heard while encouraging one another to hang in there.

    I found Thomson to be truly unpleasant and rude to deal with and would never book any travel with them as a result of this experience.

    I am not sure what to do with the two lever arch folders full of paper bumph Thomson sent me. The bureau draw is groaning under the strain of them.

    Perhaps use it to start the sitting room fire?

    Absolutely, I have often wondered if I would have the dedication and the desire to help others AFTER my case against J2. I'd like to think that I would but I'm not certain, so members like PtL Vauban, 111KAB, JPears, Tyzap and of course our very own legal magpie have my absolute admiration for their dedication, which they receive no financial reward only the pleasure of seeing others succeed where perhaps they have failed, well some of them anyway :beer:

    Despite the banter, these guys and girls make this forum a success for honest hard working people to get the legal redress against the airlines that they deserve and I would gladly include you in the above list if you could stay and pass on what you have learnt to others.

  • I finally agreed a settlement with thomson from my claim dating back to feb 13 following a 14 hr delayed flight to barbados in Jan 2011. We agreed the settlement of 2 x 600 euros + interest at 5% and claim fee on 18 Nov. The legal rep said the paperwork for the cheque would be issued that day but it could take up to 28 days to receive the cheque. The 28th day is 16th Dec and to date no cheque received so I emailed thomson on Friday giving my bank details and stating that I reserved the right to instigate recovery action should payment not be received by the 28th day.... So am I right in thinking that I could issue recovery via a small claim if it is not received by the agreed date ?

    Well I was one of the first to get a cheque (from Monarch) post the Sturgeon ruling in Oct 12, I think I got my cheque around Jan or Feb 2013, - and I still pop on here now and again with my tuppence worth!
    Why oh why don't the airlines get it? - that the distasteful way that they treat their 'customers' post a delayed flight leaves such a burning taste for 'revenge' that many of us will still be here for ages and ages yet.
    I seriously hope Monarch go bust the day after they pay the last of the legitimate claims out :wave:

    Thank you again to everyone on the forum for all their help.

    Received cheques today for flight delays in 2010 and 2014 both long haul so quite a nice amount.

    Can confirm that interest at only 4% and current exchange rate being used rather than at the time. No breakdown in letter which is very cowardly of Thomson. My court bundle had to be in by the 24th December, had I submitted my bundle I would still have gone to court to get every penny out of them.

    It's been a long struggle but totally worth it.

    Think I posted in wrong thread so re-post here.

    Received cheque from Thomson today for Palma - Manchester flight in 2006 that has been stayed in Court.

    Again interest only at 4% and exchange rate current it has been a long struggle but we finally have a cheque !

    Many thanks to all on forum for help in getting here !
  • I think Mark2spark is wrong hoping Monarch go bust, their are many people working for them who have done their best and are quite committed to their work and have been let down by bad management.I took Monarch to court and won and I still fly with them 4 times this year on time on every flight even early sometimes and I,m booked for next year.Throwing a whole load of people out of work when it,s not their fault is wrong, If the new management can turn the company round that,s a better solution

    worldwize - I think if Monarch treated their customers with respect both during and post delay I would have more sympathy and would be in general agreement with your comment and thoughts. The situation is, however, that the new management team are still failing to recognise the law and indeed show the same lack of concern/respect for their delayed passengers. It is not a case of the new broom sweeping clean more the case of them continuing to sweep the matter under the carpet.


    Although a number of the key guys have gone (Rawlinson, George, Williamson etc) to be replaced by the likes of Swaffield it seems inherent within the organisation not to like and therefore not to pay out in respect of 261/2004. The odd claims are starting to be paid out post Huzar where solicitors/the courts are involved but the majority of claimants fronting their own cases are continually being fobbed off by Monarch.
    If any airline cannot run their operation correctly and within the law then, in my opinion, they deserve not to continue their operation - it may not be the fault of the majority of their employees however they, like the travelling public and the CAA should bring pressure upon the senior Directors and personnel to act responsibly.
