"Interview under caution..."

they obviously suspect that there is something more to the situation, otherwise they would have just sent a letter stating that there had been an overpayment alonf with a repayment schedule.
how much is the overpayment they are claiming was made?0 -
are calls not recorded?
Failing to check your bank account is not a crime, fraud has to be deliberate. So if the OP can prove he informed them its unlikely he would be prosecuted for fraud, just made to pay back the overpayment0 -
No, they haven't ignored the DWP.
The DWP informed the council that my claim ended mid Dec, which is incorrect and something i am arguing with the DWP over currently. But i don't know when the DWP told the council, i would assume pretty much the same time i found out they had lost my returning to work paperwork.....mid Jan.
For some reason, the council continued to pay benefit until March.....why? I don't know?
As far as i can see, i have done nothing wrong other than not check my accounts regularly.
Your JSA was closed from 2 weeks prior to starting work because that was the last date you signed on. The DWP would have actioned this about 1 week after your signing day. At thaat time they would have informed the council that your JSA was stopped from December. The council should have stopped your HB on that day aswell. So the council ignored both yours and the DWP communications.0 -
Did I say many? Maybe it is "many" I don't know, it probably is "many".
I said I for one could relate to the OP not checking, because I don't check mine.
I don't like to see people on forums dismiss out of hand what an OP has said is the case just because it does not fit what they do in their own lives. People are different in all aspects of life.
i disagree with what you said, but im not critisizng you. i mereley pointed out to F Gaby, that people on a low incom.benefits usually know exactly how much they have, after she saw fit to jump down my throat, as she checks her account regularly.
some people just like to find fault with anything that is said.... naming no names

If the OP knew that there was a problem in one area though it would seem sensible to check her account for any other potential problemLost my soulmate so life is empty.
I can bear pain myself, he said softly, but I couldna bear yours. That would take more strength than I have -

I don't see any case for fraud here. No-one in their right mind would think they can sign off JSA, start working full time (on the books) and still claim HB continuously....it is obvious the council will eventually find out and ask the money to be re-paid so why would you do it?0

OP.... so am i right in assuming that you have the full amount of overpaid housing/council tax benefit ready to pay back?
have you bank statements showing that you have been paying your rent/council tax in full since you started working?0 -
i agree.... but the fact that they are wanting an interview under caution, would indicat that it is a substantial amount ( more than just 2 months?)I don't see any case for fraud here. No-one in their right mind would think they can sign off JSA, start working full time (on the books) and still claim HB continuously....it is obvious the council will eventually find out and ask the money to be re-paid so why would you do it?
usually they just state there has been an overpayment asnd send a repayment schedule.0 -
OP, just read your OP again
Why 3 weeks too early? You should have signed on your usual day 1 week before starting work... why didn't you? Unless it was a Christmas bank hliday signing which you were told to skip, this happens a lot to JSA claimants they get told to skip the xmas signing then something goes wrong and the jobcentre makes a mistake and closes the customers claim from 4 weeks ago. Seems you have in your own way fallen foul of this JSA xmas trap aswell.0 -

Could it be because you were working at the time?
Yes you are right, the following was dated 14/11/2012:On Monday i was hit from behind by another vehicle whilst i was stationary in traffic...hit at about 30mph and the other vehicle didn't even brake, just plowed into me.
I had to have the roof cut off my vehicle and was removed on a spinal board due to neck/back pain.
Taken to hospital where i was examined and discharged with "whiplash" within 30 minutes of arriving.
I am still in some pain, having trouble sleeping properly due to the discomfort.
I am still managing to go to work, but am in fairly constant low level pain, which gets worse if not managed by pain killers.
Can't really work at my computer for too long as it is uncomfortable due to my neck/shoulder.
I have contents insurance with Swintons, with "Home Legal Protection"....is this likely to cover me to claim for my injury?
If not, are there any recommended firms to use?0
