    Kirstie,

Now, if the weather's anything like it is here, get out in the garden with chilled alcohol and relax.

    But don't drive afterwards. ;)

    Thanks everyone for your posts!!
HO87- I disposed of the tickets that night so I'm going by what LCP have said:
They say I entered the car park at 3.11pm, purchasing my first ticket at 3.13.
At 5.10 I purchased another ticket and then the CCTV shows me leaving the car park at 7.31.
When I exited the car park I was the old car in there....so I'm not sure if I can argue it took me ages to exit? Although could waiting for my family to catch me up be an excuse?

I hope that I'm not unfortunate to receive a letter from the court but if I do I will certainly be coming back to everyone for your help as I feel these companies are just bullies and it makes me more determined to fight them all the way!?

  • Hi Kirstie - just wondering how you got on. Have they finally left you alone? I have had a parking ticket from the same car park in chesterfield. However, my ticket was issued because I didnt spot they'd changed their parking fees. No signage on main board - the only thing they had done was got some black marker pen and changed the 50p hour board and drawn a line to change this to 60p. The board is on the main road and not in the car park. Long story short, I failed to pay extra 20p to park for two hours (I had paid a £1). I appealed to POPLA with photos and was rejected. I cant believe this. LCP have now written to me demanding £80. Out of principle I'm not paying it. Its outrageous.

Come on, thousands of people have been ignoring these fake PCNS for YEARS. Your only mistake was a wrongly-worded 'soft' POPLA appeal which was a shame but now you are simply back to square one like people always used to be before POPLA existed.

I have ignored 2 fake PCNs myself and laughed at them. Simply play snap with each letter and laugh at them, come on, this isn't a fine. Read the links.

This is an interesting post. So, let's see if I've got this straight. You are saying:

    1) Try POPLA
    2) If that fails, switch to ignore mode and "laugh at them"

But POPLA is funded by the BPA and has no remit beyond October 2016. On it's own admission:

The first appeals were determined on 28 November 2012 and from then until 31 March 2013, 1,969 appeals have been decided, of which 911 have been determined in favour of the operator.

So that means you have a 50:50 chance of winning your appeal and then the best advice is still to ignore?

No, what C-m is saying is that as POPLA decisions are only binding on the operator, if the motorist 'loses' at POPLA they have the option to pay, but they also have the option to ignore the decision (and then see what the PPC's next move is).

Really Barnaclebill, if you know as much about this stuff as you purport, I would not need to be wasting my time explaining this here to you.

A bit of homework is advised for you tonight :)
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

My first two fake PCNs were prior to POPLA and POFA - obviously I laughed at them.

My latest one, they never sent any letters at all so I couldn't appeal - but would have done if I had got a NTK (and they were an AOS member so I was surprised and a bit disappointed that I only got the rubbishy ticket to snigger at).

POPLA decisions are only binding on the operator, if the motorist 'loses' at POPLA they have the option to pay, but they also have the option to ignore the decision (and then see what the PPC's next move is).

It's a fact that some people lose at POPLA because they haven't looked on a forum first. It's a shame but it is true, and sadly we can't help them further than telling them to ignore the PPC and see what happens. No-one should just pay!
