Ok got myself a number called them and gave their customers policy number, Zurich says they cant deal with anything as its not been reported to them as yet .... Great eh

As I say, commercial insurance tends to be slower.

Can you report it to them by phone? If not send them a letter of claim. They will still have to contact their insured and await their response and that may be direct or may have to go through a broker.

They asked me to call back tomorrow hopefully at that point they will have received something and can then add my details as the 3rd party .... Until then they say there isnt a case number they can add info too

Personally I would still write the letter today. Almost all insurers will register a claim on the basis of a letter from a Third Party or their representatives but very few will do it over the phone.

The letter is a straight forward one saying what happened, where and when, who their insured and driver is, stating that you hold them fully liable for the incident and require that they sort your repairs out. If the vehicle is currently not roadworthy certainly mention that and potentially that you will be claiming loss of use whilst it is off the road awaiting their repairs.

Get in touch with the third party direct, they may be happy to settle without using the insurance if they are only a small firm.

Thought i'd give an update on this

Seams My day insurance rather than working for me seam to be working against me, after having issues with them i went direct to Zurich being the party i was claiming against and they have admitted liability but just had a call off My day insurance claiming that i may have taken out insurance AFTER the accident rather than before , i'm claiming the accident happened at approx 10.30 am 30 mins after taking out insurance they are claiming the accident happened at 9.30am.

Now i will be disputing this as i know what happened but my question is will Zurich now delay because of this discrepancy ?

Have you tried contacting an accident management type company such as: http://www.easidrive.com/

There are quite a lot of companies out there who will take care of the process in a non fault accident.

I've not seeing as i thought it may be quicker to handle it myself ...

If there is a discrepancy over my insurance cover should that matter when they have admitted liability ?
