Car crash ( none fault ) insurance won't deal with it

Looking to find out what my next step will be :(

I had a car crash last Friday morning, i was waiting at a roundabout attempting to join it when an HGV ran into my rear he said he thought i had gone and couldn't see me in front of him, it was a low speed bump but its probably caused damage to the car that would make it uneconomical to repair.

Now to put you in the picture the car hadn't been insured for about 6 weeks prior as it had been cancelled and i was doing work on it for its MOT all that work had been done and the car had passed it MOT and been sold on ebay Thursday evening. I took out day insurance on the Friday morning in order to take the car to be cleaned before it was collected and paid for by the new owner, 20 mins later the bump happened.

Now my day insurance is saying they WON't handle my claim as my previous policy for the car was cancelled for none payment ( the last payment wasnt made on time ).

So eventually to my question, do i now have to handle this claim myself if so how ? ..... Do i contact the other drivers insurance company, will they even deal with me ?

Any help or advice would really help

You can contact the TPI and deal with them directly, if they are willing to. If not you will need to deal with matters yourself and go via the courts for recovery (or at least threaten to).

Alternatively you can contact a Credit Hire company, given the circumstance and the indemnity issues on your own policy they may be willing to do credit hire and credit repairs for you but you'll have to tell them that your own insurers have refused to deal with you due to non-disclosure

I would caution against going for a Credit Hire- if the accident occured post sale as you indicate then if they put you in a hire car the TP insurers would rightly ask why you required a hire vehicle.

Hi and Thanks ... The TPI is with Zuric if i contact them are they likely to deal with me direct ?

I won't be hiring another car as i already have another vehicle i can use, just want movements on the damaged car as quick as possible

Most insurers do and I'd be surprised if Zurich doesnt however given it was a HGV then things may be slower than if its a personal lines policy simply due to the more complex nature of commercial lines

there is no need to involve your insurance company at all, as long as you inform them of the accident (which you already have)

Deal directly with the other party insurance, quicker and simpler.

Ive done it twice now, simple and everything was sorted within a fortnight.
make the most of it, we are only here for the weekend.
and we will never, ever return.

Not for dealing with Zurich, the fact you have indemnity issues is irrelevant to liability/ them.

You may need to if you were going down credit hire/ repair route as unless the ABI rules have changed then there were only certain circumstances where credit repairs were supposed to be done (ie where there is no other option)

No, but if you call their motor claims line and as to speak to the "Third Party Team" or explain the situation then they should be able to transfer you or give you the right number
