    Certainly Not ... The Absolute Minimum Notice Period for any AST is ONE month (Often Longer) ...
    And even then, you do not HAVE to move out until a Court Eviction Order is obtained (which can take months)

    Firstly contact your landlady immediately in writing and inform her of this guy.

    In the mean time if the guy calls round again get his name off him, ask him whether he is going to evict you in 2 weeks if you don't pay and if he says "yes" tell him you will report him to the police. Then close the door. In no uncertain terms let him in the property keep him on the doorstep.

    After he has gone make a complaint to the local police for harassment. Just give his name and make it clear you have no idea whether he has anything to do with the landlady.
    I'm not cynical I'm realistic :p

    (If a link I give opens pop ups I won't know I don't use windows)

    Be sure to make copies of letters and keep a written record of when and how you try to contact your landlady, and this chap's visits.

    i will explain in some detail my situation, will be long so im sorry.

    I am on home bond scheme so deposit was paid by hb as my previous LL sold house and i needed accommodation urgently as i have son with autism so routine is important as is secure living.
    my tenancy as on this scheme is for 12 months.
    i have housing officer.. who did warn me about rent with LL said keep proof etc.
    pulled a face when i said her name:eek:

    i know her name but was only given 1 piece of paper from her which was tenancy agreement, cannot find it but am seriously looking.

    in previous rented acc i always paid my top up rent to LL either through bank or on weekly collection, depending on LL.

    however this LL has only called once in nov asking for cash payment as explained before i asked her for bank details so i could sort out direct debit therefore having the proof of payments too... no details have ever been received.

    my rent is being paid by hb as i am a full time carer. but top up i have to pay.

    i am a bit worried about contacting hb in case they then stop payments if LL is queried.

    my bf is a policeman.. lucky me:D
    but although he sees me often he cannot be here all the time, but like advice received he says to not entertain him, and call police if harrased.

    i really want to seek legal advice but think it be best to wait for letter.. if it ever arrives.

    do you think i could be evicted for not paying the top up rent which is £50.00 week? even if i have not been given a direct way of paying?

    i hate that im worried to answer the door, confrontation is not my strong point, especially as he said to my daughter that he is the nice one and the other's wont be..

    sorry to go on, just not sure what i can do without any evidence at present.

    You would only pay this money to the LL, because paying it to anyone else without having documentation to say that they're the new LL would be utterly crazy! Therefore if the LL hasn't come weekly to collect it, and she hasn't given you direct debit details, then it's not your fault. You've phoned her enough times and made the effort to pay.

    Just don't let this guy into the house, and don't panic. Put the £50 a week into an ISA, so it's there when you need to pay the correct person, but don't go handing money over to someone you don't know, or you could end up having to pay twice.

    MOST Councils require a copy of the Original Tenancy Agreement as an essential part of their HB documentation .... Therefore, ask your Housing Officer for a copy of it as you have "temporarily misplaced" yours.

    ---> HB will NOT stop your usual HB payments over a "Top-Up Dispute" (so long as you are still resident in the house)

    ---> As you know you ARE liable for the "top-up amount", you SHOULD have been putting that money aside each week/month (& should continue to do so) in readiness for paying it to the LL when (& if) you finally get a payment request from your OFFICIAL Landlady ... IF you have, then No Problem and you can't get evicted, but if you haven't, then I strongly suggest you start getting the back payments together ASAP as you COULD get evicted if you don't pay it upon "Formal Request".

    The Council can't touch you for that, even if it were in one account.

    That money is not legally "your savings", and is actually "your landlords money held IN TRUST".

    They have to go to court to evict you.

    It would be easier for them to evict you if you are in rent arrears therefore you need to attempt to make payment.

    So concentrate on finding your tenancy agreement first and getting the landlady's address.

    Send the landlady a cheque by recorded delivery to her address for the outstanding rent. Include a letter saying that due to her not giving you her bank details as requested you have now sent a cheque (cheque no. xxxxxx) for the outstanding amount you owe. Keep a copy of the letter and the recorded delivery receipt.

    If the letter you wrote is returned to you keep the letter unopened in a safe place.

    Then every two months send a repeat letter and a cheque for the outstanding rent owed . Again use recorded delivery and keep copies.

    Due to the potential of violence and the fact she is known as dodgy I would ensure I had proof of doing things.

    DO NOT spend the top up rent money. If she calls round or sends a letter saying you owe her rent you can give her/send her the unopened letters again.

    BTW I had a landlord who while was a good landlord refused to give any of his tenants his bank details, we either had to post monthly cheques or leave them for him to collect every two months.
    I'm not cynical I'm realistic :p
