    Bear in mind that some schools have administrators on no or reduced hours in school holidays so it may be oossible that the Total jobs rates are the fulltime rates but in reality the actual wage is pro-rata so may fall below the threshold (and might explain why she chose this particular job if you want to be cynical).

    Just a thought.

    Yesterday I received the PreliminaryDecision from Legal ombudsman. They senta 16 page document including details answering all the concerns I raised butthe outcome is as expected the preliminary decision is that the serviceprovided by the firm was reasonable. Below is the extract from the document with the statement for thepreliminary decision:

    JackRS made a complaint to the firm on16 July 2015 and they provided their final response on 5 August 2015. JackRSraised another complaint on 29 October 2015, number six below, during myinvestigation. It was agreed by both parties that I would investigate thiscomplaint. The firm responded to this complaint on 11 November 2015.

    The following complaints have beenaccepted for investigation:

    1Matters have failed to progress and the firm delayed in putting proposals inwriting and in sending counter proposals;

    2JackRS feels that costs were excessive compared to the service provided andpoor management of an actuary’s report led to higher fees;

    3Documents had mistakes that required JackRS to check and correct them;

    4Unnecessary work was conducted including a house calculation when the purchaseprice was already known;

    5Inconsistent advice was given in terms of the discount for a pension cash sum;and

    6The firm failed to identify and advise on the fact that the consent order doesnot include that JackRS former wife provide proof of her income in relation tothe one of the trigger events for the spousal periodical payments.

    Mypreliminary decision is that the service provided by the firm was reasonable inthe circumstances except for their delay in sending counter proposals and anerror in the figures of the Cash Equivalent Transfer Value (“CETV”), but nofurther action should be taken as the firm have already apologised for thesemistakes.

    It seems in the legal profession if you make a mistake orcause a delay an apology is all that’s required, it’s considered reasonable andyou’d suffer no consequences, just the fee payers who suffer the consequences. This doesn’t give much hope to clients likemyself and further fuels my mistrust of the profession. I can see I’ll be wasting my time appealingas I feel the legal ombudsman is really there to protect the service provider.

    I think I will respond and state I don’t agree that it isreasonable for the service provider to act like this but can’t see it gettinganywhere. I appreciate many of you willthink I should draw a line and put it behind me, and I will. Maybe my experiences can help others goingthrough the divorce process and equipthem with some wisdom. The legal serviceproviders are a business with key objective to generate fees, just like anyservice provider their primary source of income is from individualclients. In my experience they gave melittle added value but I couldn’t make that conclusion until near the end ofthe process. Many like me are scared asit’s the first time they enter this process and feel that if their ex uses asolicitor you will also need to but I don’t think that is always the best pathbut for everyone it is unique and specific.
    Take care everyone

    Oh Jack, I am so disappointed, on your behalf, at the outcome of your complaint.

    Like many of your "Friends" here I really thought your solicitor had failed you.

    It just seems so unfair.

    I do hope you are still enjoying your freedom and that life will be kind to you from now on.

    Take care

    i would personally find some review sites and name and shame them, even if it stops just one person using their 'services' i think it would be worth while for that person at least

    on a £100 shop you might on average get 70 items save
    10p per product = £7 a week ~ £28 a month
    20p per product = £14 a week ~ £56 a month
    30p per product = £21 a week ~ £84 a month (or in other words one weeks shoping at the new price)

    Jack,
    That is so unfair, you have acted like a true gent in all this long and sorry saga.
    I do think that you should now put it behind you, after sending a reply stating your disagreement with their reply.
    The only consolation I can see now is that you have rest of your life to look forward to and you can have a peaceful one.
    You can hold your head up high.:)
    Treat other's how you like to be treated.

    This is so, Jack.

    I differ slightly from kelpie:-) We KNOW BOTH your solicitors failed you, the forgot-I-was-pregnant and the former-colleague-mediator and the stuart-lancaster-incompetent and the parachuted-in judge.

    You - Jack - are the success story in all of this.
    Lodge that letter of dissent, with the requirement that it is acknowledged as such and remains on record, cross-referenced against Bretherton's. [There, I've named them.]

    I hope your new Life is shaping well, DIY, Uni daughter, turmoil son et al.
    All the elements are good, Jack - personal happiness will filter in and suddenly be at your core, at long last.

    ......and another month on, Jack, but how different from this time last year:-)

    Tant mieux.

    Your last report here disclosed the Preliminary Decision cop-out. Was there ever to be a fuller report, or was that dependent on you appealing against those first Old Boys' Club decisions? If you stated your disagreement re: 'service provider', then drew a line, amen to that.

    For now, I'm hoping it really can be your first really Merry Christmas as a free man for many years. May they all be so from now on.

    Thanks I just responded that I didn't accept the preliminary judgment of 'it's ok cause they said sorry' received the following reply:
    Iacknowledge receipt of your email and note that you reject my preliminarydecision.

    The next step are for your complaint to be referred to an ombudsman for a finaldecision. I anticipate this will take at least four to six weeks. You will becontacted again once a final decision has been made.

    In response to your comments about the remedy I would say that the remedy willdepend on the poor service identified in each complaint. In this case on thebasis of all the factors identified in my preliminary decision and in thecircumstances I felt that the poor service identified was minor and thereforean apology was a sufficient remedy in this case. If this had not already beenprovided by the firm I would have required them to do this.

    It will go to ombudsman for official judgment with the outcome likely to be the same..

    I have £556 left to pay for my legal fees to Brethertons, which I plan to pay off in January, as I've been paying £500pcm. That I hope will be the end of it....

    Heard from my parents that my ex has bought a 2 bedroom house not far from her parents on the coast where she lives now with our son and when my daughter visits, most weekends, she shares her bedroom. She managed to buy somewhere mortgage free. All 3 of them visited my parents on Saturday.

    I met with daughter in London last week, took her for a meal and to a concert in the 02. Maybe I'm over compensating but got her a new guitar that she was trying to save for but I thought it would be better for her and a bit more exciting if she had something to open. She opened it while I was with her and was thrilled. It's a combined Christmas and birthday present as it's a lot more than I would normally spend. Yes I'm spoiling her but it gives me great pleasure to give her something she wants rather than what she needs and supports her chosen career/hobby path...

    Once again thank you all so much for your help and support this year.

    Have a great Christmas and New Year everyone ! :xmassign:
    Regards
