Separated, how much should I provide?

  • Hey Jack

I'd nip this latest 'reasonable' offer in the bud with one email explaining that this had already been put forward during mediation and was rejected by you.

To be honest your solicitor sounds about as much use as a chocolate teapot!

Or you could counter-offer that you are willing to hand over a larger share of equity in return for no claim on your pension plus a monthly payment until a trigger point, which includes you retiring. Then when the agreement is signed promptly take early retirement - job done!

Can't work out how to put the letter on here as it's a pdf so can't copy and paste, I can see there's an insert picture but links to http but not sure how that works?

I hope the viewing on your FH reaps success.

I just have no words to describe my feelings about what you are being asked to provide.

Hope you have a lovely time with your daughter on Sunday.

Forgot to ask have you had any reply, to your letter/email, re the reduced monthly payments.

    Take care

Gosh, they really want to punish you for falling out of love with your ex, don't they?

I don't see why you should have to pay her £1150 each month, I don't earn much more that and I work full-time in London! She doesn't have kids to provide for, she doesn't have a job that she needs to drive to, this is having the cake, eating it, and taking away the plate, cake knife and the table that it stands on!

Still, at least it's a start, I suppose it's like haggling at the market, vendor starts off with a ridiculous price, you go in with a ridiculous offer and you meet somewhere in the middle. Give her half of the house, and the fifty-odd grand, fight all the way against the spousal maintenance and car and you might just be shot of her this side of the 21st century. I like the idea of early retirement though, could you possibly "retire" then go back to work for 3-4 days a week? If you get a clean break, she won't be able to come back for more cash.

Agree with the poster who suggested the "House buying, renting and selling" board for your rental queries. From what I can gather, you can claim compensation for your deposit not being properly protected but the 3x deposit is the maximum amount that a judge will award, it is not guaranteed that you would be awarded that.

Yes it's mentioned as a foot note in the letter from her solicitor with the details of proposal which was why I wanted to post it but don't know how to on here. Anyway I'll type out what was said about that below:

‘In writing, we would express our client’s concern at the contents of an email sent to her by your client on 29 September 2014. In that email, your client proposed to reduce the level of global maintenance paid to our client from £1150 per calendar month to £650 per calendar month. Should we not hear from you by return that your client will hold off making any such reduction, our client will have no option but to consider making an application to court for Maintenance Pending Suit. We anticipate you will agree that that would be an unfortunate necessity at this stage of proceedings.'

Suppose it is a progress, ? Instead of two grand forever she asked for one grand forever . I guess you need to discuss I'm.depth with yur solicitor :D
The word "dilemma" comes from Greek where "di" means two and "lemma" means premise. Refers usually to difficult choice between two undesirable options.
Often people seem to use this word mistakenly where "quandary" would fit better.

For hard of hearing - it was a joke re discussing it with a solicitor

I can't understand why any solicitor , or anyone come to that, is even considering giving her maintenance?? Why FGS? She has no kids, she can go out to work and pay for her own life, it's women like this that give women a bad name. I'd rather give up work than give this leech a penny!!

Jack, what does your contract state about the second car? Is it only applicable for people on a certain pay band?

As for the maintenance and a three bedroomed house, well I'm gobsmacked. Personally, I'd be inclined to tell them to go for the "maintenance pending suit" case but I appreciate that you may not be in a position to do this. Legally, you owe her !!!!!! all at the moment and I think you're being generous in offering her £650 and the car and the house. Hell, I take home that a month and have to pay a cars running costs and household expenses from that. She needs to pull her belt in and work on how she can cut her expenditure

I really hope that you can have a restful and enjoyable weekend
