I'm not an ebay expert, but it does sound as if she is a business (whether she has registered as one is another matter). I would try quoting distance selling regulationsReturning faulty goods
The Distance Selling Regulations are in addition to your other legal rights.
So, if your goods are faulty and don’t do what they're supposed to, or don’t match the description given, you have the same rights under the Sale of Goods Act as you have when buying face to face.
Any terms and conditions that say you must cover the cost of returning an item wouldn’t apply where the goods being returned are faulty.
Based on that I would contact the buyer, quote that, and say goods are available for collection at a mutually agreeable time and date, or alternatively please send me a pre-paid label to return the item. I'm betting they won't bother, but you have made an offer to return the item.

Message her and tell her that is unacceptable that she did not list that it was a size 16 even if it is more of a 14 its not stated as a 14. Sometimes size makes all the difference for example I couldn't fit in to a pair of size 8 jeans but I could fit in a 10 and I would be very annoyed if i ordered what i thought was a 10 then it turned out to be an 8, il be the judge of if smaller/bigger clothes fit me not some one who doesn't know my body type.
If you open a case she is likely just to refund you with out asking for it back as it saves the hassle, if she doesn't then she will have to pay you back the cost it cost her to send, she described it incorrectly so therefor she has no choice, i could understand if it was a 14 and it just didn't fit you but its not.
Before opening a case I would advise you to continue communication with her. Tell her that its unacceptable to say false sizes and she is breaching ebay's terms and conditions. Threaten to leave negative feedback. Try to get her to send you extra money to send it back to her too. If that fails then i sugest you either keep it and forget about it (leaving her negative but truthful feedback) and then re sell it to get a bit of you money back. Most sellers offer a refund after you leave negative feedback if you reverse your feed back, ive brought a dress before that STANK of heavy smoke, The lady refused to refund postage so i simply left her negative feedback and she told me she would refund me if i changed it to positive and she let me keep the item to!0 -

If we buy something on EBay that is incorrectly described and the buywer refuses to pay the return postage but wants the item back before refunding it, we lodge a return request via EBay and get a returns label through them. We certainly don't pay the return postage. The item is incorrectly described. You shouldn't be left out of pocket. That's EBay's claim. Make them live up to it.0
