Have you actually tried the top on? Is it a size 14 despite what the label says?
Are you unable to wear it because you have an aversion to what the label says, or because it is in fact too big? You say you wouldn't have bid if it was described as "labeled 16, more like a 14".
Because if it is actually a size 14 despite the label, then it is as described. It is a size 14. The label is wrong, not the item listing.0 -

Is this seller selling a lot of brand new items of the same type?
If so, they may be a business seller, and if so they must accept returns, and cannot withhold postage.
The selling a lot makes them sound like they could be an unregistered business seller.0 -
I would have thought this could go as a large letter if it was laid out flat and kept thinner than 25mm/ about 1 inch.0

I'm a stubborn sort and I'm afraid your sellers comment of "I will only refund cost of item not postage, as I don't usually accept returns" would be like waving a red rag in front of a bull with me.
I'd be inclined to show her that yes, YOU WILL refund the full cost and YOU DO accept returns and if she continued to be arsey I'd show her what negative feedback looked like as well.
I'd pay a few quid to teach her a lesson personally.0 -

Hello again - an update. Pullip - that's exactly how I felt, so I stood my ground. She's flat out refused to accept that she was wrong, and offered half postage as a refund, which I refused just on principle. I just now escalated the case, and received an email within 5 minutes from ebay to say they'd refunded me.
Thanks everyone for your input - I'm £4.49 richer!

From your OP is sounds like she's running a business (ie selling multiples of the same item) so I have a feeling she's actually breaking e bay's rules by NOT accepting returns, I think. If she has misdescribed she should pay return postage.

If it was a no fault return then you can charity shop it or whatever you want.
