Scan.co.uk - Restocking fee on incompatible item

Hi everyone,

Just after some opinions on my rights with this situation.

I bought a laptop charger from Scan on 25/3/13. I ordered online and then collected from their premises (about 12 miles away). The online description was quite basic and when I got it home I found it wasn't compatible with my Dell laptop. It didn't say it wasn't compatible on the online description so I put it back in the box and decided to take it back when I was next passing.

My wife was going that way today (12/4) and so called in to take it back but they said because I hadn't taken it back within seven days I would have to pay 10% restocking fee. Am I right to expect a full refund?

    It's not clear from your post whether you purchased at a distance.
    Did you pay online or did you pay in the shop?

    Under Distance Selling Regulations you have upto seven working days after delivery to cancel the transaction.
    Did you notify Scan within that time of your intention to return the goods?

    If you did purchase at a distance then DSRs apply.
    Then if you cancelled the order within the above mentioned time limit then Scan cannot charge any restocking fee and must refund all monies paid.

    Otherwise, you are at the mercy of any returns policy Scan may have.

    I purchased and paid online but collected instore (using Qcollect). I never notified them as I didn't think I needed to as it wasn't the case of not wanting the item/changing my mind, it just wasn't compatible with my laptop.

    You left it over 7 days so they can do what they like. They probably don't even need to take it back.

    How much are we talking about here? If the charger was less than £20 10% is so insignificant I wouldn't bother taking this further!

    But did they say it was compatible?

    They never said it was or wasn't. It matched the specs of my old one re: power input/output and came with seven different adaptors but none fitted the Dell which I think is a very common laptop brand.

    As it has a manufacturer's phone number on the listing you could have called them before purchase to check if it supported your laptop I think you will need to take the hit or try putting it on ebay you might be lucky.

    When you picked it up why didn't you ask them?

    For the sake of £2 I would just write it off and learn from your mistakes.

    But there is nothing wrong with the goods.

    You made the mistake and bought the wrong thing.

    It is simply a case of you having made a purchase and then deciding you do not want what you have bought.

  • I have to disagree with you wealdroam. Agreed that the goods probably do work, just not with Dell laptops. I made the mistake but read it as a 'universal' laptop charger and believed that it would work, Dell being a very popular brand. I decided I don't want it because it isn't compatible, not because I have changed my mind about wanting the product. I would have gladly kept it had it worked.
