Hi all,
I am currently trying to claim Lloyds for approx 3k worth of charges. I issued the initial letter and got my statements in response. 2nd letter outlining charges was posted and received by Lloyds on 14th May. Having called them daily since the 14 days were up i finally got a response saying that the my case was being reviewed and they would get back to me by 26th June to let me know if they are going to defend or give me some kind of payment as a goodwill gesture.
Should i hang tight until the 26th June or continue to chase? Is this a delaying tactic or is the 40 days + anything significant for them to use in order to get out of this?

As far as I am aware the banks have 40 working days to deal with your claim.
For example- I sent my claim to RBOS on 4th April by recorded delivery. Because of the bank holiday they never actually received it until 12th April. I received the statutory response letter "are looking into caim blah blah" on 13th April. My total claim was for £3300 but I made a without prejudice offer of £2600 if the claim was dealt with in 14 days. THIS MAKES NO DIFFERENCE WHATSOEVER as every time I have called their hotline they tell me that they have until 11th June (there have been a couple of bank holidays) to make me an offer. I spoke to somebody on 1st June and was told that an offer letter for £2600 had been agreed and generated... but I could have to wait until 11th June before I receive it!! If I accept the offer it will then take up to 10 days after they have received my acceptance letter to pay the money into my account.
So the banks will take each stage to the limit as their way of inconveniencing us customers and also as a way of trying to wear down our resolve. Do not let them win, stick to your guns and do not accept any "good will gestures" as final payment. They cannot win in court and even if you are unlucky enough to get a judge who rules in their favour, they will still either settle in full after the case, or face the certainty of losing at an appear hearing and setting a precedent that they will then be bound by in all cases. These charges have been PROVEN in court to be unlawful so don't let them try to make you believe otherwise.

I need advice!
I sent in a list of charges to nat west and two weeks later they replied, we will study your request when we can and should be able to let you know if you can reclaim your charges or not in about 6 to 7 weeks, that was about a week ago is now time to threaten to take them to court or just wait????0 -
Hi all
I have filed a small claim against HSBC, they acknowledged my claim and said they would be defending. Ive heard nothing from them and tomorrow is the 28th day. My question is, do i enter request for judgement tomorrow or Saturday or Monday? I obviously want to do it asap so no defence can then be entered and my claim would be complete.
Does anyone know what i should do?
Its worth noting that i recieved an offer from HSBC yesterday for a seperate account and seperate claim (which i have accepted). This other claim was all done on the same timescale it would also be on the 28th day tomorrow, but i have accepted their offer. Do i need to let the court know??

I spoke to someone at MCOL and he said you can request Judgement by default at 00.01am on 29th day. If that's Saturday morning, I would do so and it'll sit in the system until Monday. It's a question of time. As far as I know once the 28 days are up and you've requested the judgement, you've won, but if you leave it, then bank might sneak their defence in whe you're not looking. Right some advice needed please......
I have received an offer today from RBS for nearly £1600. This was my original claim amount which does not include interest and court charges which I have applied for since issueing my claim.
I have just spoken to someone in customer services to say that i am not happy with the offer and am claiming for interest and costs too. She was adimant that RBS are NOT paying interest and charges only repaying the charges in full (liars!!). I challenged this by saying that I know that people are being refunded interest and costs but she dug her heels in.
What do I do now? RBS acknowledged my claim today- they dont appear to be defending it (checked on MCOL) so can I still start a judgement?
has anyone else been in this situation or had a similar response from the bank? I dont know what to do next for the best. I wan to claim the full amount but im worried that i risk losing out altogether.
Advice will be greatly appreciated

I have received a letter from Lloyds/TSb offering to pay me £750 ( This has also been put into my bank account as a good will gesture!). I was originally claiming back £4000 worth of charges. Should I accept this offer? or take it further?

DONT accept this offer, they will always offer you somthing, but £750 is laughable, they will go higher.hope that helps0 -

Im no expert, but, i had an offer from hsbc which was for the amount claimed but not including interest or costs. £1400 claimed £1200 offered. I have accepted the offer as it is not too far off the mark or the figure i wanted. They offered me this on day 26 of waiting for their defence. This was another factor i took into account when i recieved their offer as i didnt really want to have to go to court - far too scary! But would of seen it through if neccessary.
I think its basically your decision whether or not to accept an offer. I really needed mney so accepted the offer - actually ripped their hand off!

Can any one please advise, i'm extremley anxious, as the process of taking natwest to court has now arisen. I have done the money claim on line paid my £120.00 and now they are saying that because of Natwest putting in a defence it has gone to my local court. Im Claiming charges up to the value of £3013.98 they have now put up a defence with Cobbetts, who are asking for CPR part 18, after reading some other posts on this matter i sent back another letter to Cobbetts outlining all charges being claimed for along with informing them that this is an intimidation tactic of which i intend to bring to the attention of the court. I am absolutely papping them and need to know what others may think the next stage will be. Do i have to go and see a solicitor myself and get representation.:eek:0

I would like to rip off a little more than their hands but thats quite violent and I might get arrested for it.:D
Its very tempting to take the offer but to be quite honest I think I should get my court fees back, after all if they had stuck to my time scale I wouldnt have put in the claim. I couldnt really afford the fee at the time but thought as I was pretty sure I would get it back, I did it.
Now, although I am still about 99% sure that Id get it all if I carried on through the court, their is still that worry at the back of my mind that the whole thing will go pear shaped!

please help i started my claim against halifax on 2nd feb 07 took 2 letters and loads of phone calls just to get my statements through in the end put in complaint with financial ombudsman, had a letter from halifax on 26th may offering a goodwill gesture of £980 which i telephoned and declined as i'm claiming back £2555 but when i went to the bank this morning they have credited my account with £980. when i phoned the ombudsman they say just to leave the money in my account and so did the halifax they say they will deduct this amount from anything i receive what do i do? it's been going on for ever please advise.0

Have started the court process with Natwest, they were served 30/5/07 and have acknowledged 6/6/07 so I understand I now have to wait 28 days in which they have to defend. Is the 28 days from 30/5/07? Has anyone else got to this stage with Natwest?
