Harassment is not a civil matter but a Criminal matter whereby courts can award huge amounts of money.
Barclays should know better as with all the banks

IT'S ODD ... Such a big bank as Barclays are stooping so low as to actually think they can harass people and get away with it

I am currently progressing my claim at the moment - do you happen to have the 0800 number to call them on - I have seen it posted before on the site but didn't take a note of it and now can't find it

Amount claimed: £450.00
Amount paid (so far): £208
Wrote twice to them asking for a list of charges. Received two patronising brush-off standardised letters and no list of charges.
Worked out amount owing from my own Microsoft Money program and the Martin's interest calculator. Sent my own "letter before legal proceedings" to their litigation department and received a third patronising brush-off letter in reply.
Issued County Court Summons via MCOL. Nationwide acknowledged service on 3rd May. They had 28 days from then before I could request judgment on 31st May.
On 29th May a mysterious "correction" of £208 arrived in my account. On 30th May they lodged a defence with MCOL and the system says I can't view anything else on-line, will have to wait for hard copy of the defence to come through the post, to see what it says.
Have no doubt the rest of the money will be forthcoming, but they are determined to string things out as long as possible hoping we will be fobbed off and fall by the wayside.
This is a mutual Building Society and I find this treatment of its Members reprehensible.0 -
Can anyone tell me please if the banks can change the 40 days for to get statements to 70 days as so many people are now claiming. Is this right??
They cannot change the statutory entitlement to receive the data within 40 days. This is laid down in the Data protection Act and they cannot change that. However, they can take longer than 40 days and do so.
You can complain to the Information Commissioner at the delay but be aware that there is a backlog of complaints to be dealt with and so you will still be waiting. Might be worth advising the bank of your intention to complain at the delay and see if it hurries things up but really, dont hold your breath. :rolleyes:0 -

Hi filed court action against MBNA,it was issued on 22/5/07,as of yet no defence, do i include weekends as part of their 5 days to serve and 14 days to reply before i can enter for judgement0

Hi, need to find out what happens next, have done all the normal stuff and lloyds had entered an ackowledgment to the summons i did via mcol on the 26/4/07. Went back to mcol on the 30/5 and still no defence was entered by the bank so clicked on enter judgment and today recieved letter from court saying judgment has been entered. do i just sit and wait now?0
