    H there beleve you me barclays are a even harder nut to crack more like a bloody brick they have just theatend to take me to court to reclaim my overdraft

    just as a thought regarding my reply as above can anybody give me some advise regarding this intended legal action against me by barclays

    any advise will do regards

    putting in lloyds.co.uk and it goes to a list of dates, then is still going to netbenefit!!!! Tried 12 different dates!!!

    What Should I Write In The Particulars Of My Claim??

    Please read the Reclaim Help Thread where you'll find a short (for MCOL) and a long version (for filing at local court) of the Particulars of Claim.

    If they have only written that they 'intend' to take you to court and you havent received a summons then I shouldnt worry about it. Worry when the summons arrives and deal with it then. Of course your defence for not paying the charges to them is that they are unlawful and you already have all the information regarding why they are anyway. :)

    Thanks twinkly at the moment all the threats are coming over the phone,have had 4 calls today alone and at least 8 during the week
    on the last call i told them this is harassment and i would take out an other legal action against them for harassment if they didn't stop
    i now exspect loads off letters in the post ,or more phone calls
    can they do this or is this there way of putting presure on me because i filed on MCOL o and by the way have not been able to get on MCOL all day think it has crashed

    I'm really sorry about that nightowl. perhaps I was just lucky with the bank/date I needed. I don't know what else to suggest. perhaps there is an individual Lloyds thread(like the halifax 1) and someone may have the info on there. I haven't really read up on other bank threads as I'm dealing with Halifax.

    Harassment is not a civil matter but a Criminal matter whereby courts can award huge amounts of money.
    Barclays should know better as with all the banks

    I've started a second claim three weeks ago; got a letter saying they'd take 6-7 weeks to investigate.

    Anyone else got something like this?

    This applies to the individual who harasses you, it will also apply to the bank if they are aware that the individual is harassing you.

    Such a law could mean that the individual harassing you (the employee of the bank) could be prosecuted. A severe warning to bank employees who do this

    Can anyone tell me please if the banks can change the 40 days for to get statements to 70 days as so many people are now claiming. Is this right??
