    They issued the summons for the inflated amount of debt on his account and with the £70 court fee this brings it to over £1,000. Our calculations is that he owes the bank around £600 and we do not dispute this but the charges over 6 years are just under £3,000 with on some occasions amounting to £75 per week almost half of his wage. :eek:

    I took your advice and joined the CAG website, I have been reading through most of the morning.

    I can't seem to fnd a letter that relates specifically to credit and store card charges.
    I've read the one about bank charges and it's ends with saying
    "I would be happy to collect the Data from my local branch"
    should I just take this part out? (as ge capital etc do not have branches that i'm aware of)

    my worry is that if i edit this wrongly i will not be taken seriously :(

    From here you put in the site you want i.e halifax.co.uk and it finds old versions of the page I managed to find T&Cs from April 1999.

    You just make amendments to the things that are specifically different in your case and the things that don't apply. So long as the general feeling of the letter remains the same you'll be okay.

    This was very helpfull to me.
    I am currently in the process of trying to reclaim my charges back,but halifax keep trying to fob me off.
    I sent the first letter requesting my statements for the last six years.Got them within 3 weeks.Then sent the next letters saying i would like them to refund the charges totaling £6500,and they would need to reply to me within 2 weeks.After 2 weeks they said they would investigate and that they would need 4 weeks in which to do so.4 weeks later they sent me a letter saying that they would need a further 4 weeks to investigate.I was worried i would'nt get anything,but after reading your response i am more upbeat about getting them back.Thanks again:beer:

    Barclays have so many "Departments" going under different names that I am finding it confusing preparing the case for court. :confused: I have today discovered yet another "subsidiary" called "Dual Prime" Any ideas?:mad:

    Barclays have summoned us whilst we awaited a response to a complaint sent to their complaints dept and being advised by them that this would be looked into and that they would get back to us. They did get back to us by almost immediately issued a summons 8 days later! :mad:

    IS THIS A NEW TACTIC BARCLAYS ? :money: :money:

    We have obviously counterclaimed! :p so there!

    Has anyone else out there had this done to them? i.e. the bank finds out that you are taking action and then beats you by sending a summons before you have had chance?


    HI ther this not a new tactic as i have had threatning phone calls from barclays,had 3 today and counting ,tHis all started when i filed on MCOL
    THEY HAVE TOLD ME THAT THEY ARE GOING TO TAKE ME TO COURT TO RECLAIM THE MONEY BACK FOR THE OVERDRAFT SO BE CAREFULL THEY GET DIRTY ER AND NASTY

    Some people get refunded after a couple of letters some have to go to court ( even for small amounts) however i think that you are right in thinking that Lloyds are one of the hardest nuts to crack, especially for claims over £1000.
    I started pursuing Lloyds for a refund of £4714.00+ interest in Feb and its still not settled.

    H there beleve you me barclays are a even harder nut to crack more like a bloody brick they have just theatend to take me to court to reclaim my overdraft

    I have not placed a message in the discussion forum before so, not sure if I have done it right. I do hope that someone can help me with this question
    I wish to claim back some credit card charges, and the credit card was originally taken out with Frizzell, ( CSMA credit card ) I have not had this card for years. However Frizzell then passed over details to Liverpool Victoria, who then passed details over to a Finance company last September. Who do I send the first letter to ? regarding claiming unfair charges. Does anyone know please.
