  • Hi Everyone
    My name is Sam and I have on ongoing claim for bank charges going back
    for over a year. The bank in question has slapped on charge after charge,
    sometimes taking family allowance and tax credits from me to cover the
    charges that were applied. When I originally put in my claim I was self
    employed in a business with my husband, which is now closed, due to the credit crunch. We had to sell the family home as we could no longer afford to keep up the mortgage payments and pay the bills that went with owning a large house. When everything began to go pear shaped I wrote to Nat West again and told them about our financial hardship. I was sent an income & expenditure form which I completed and returned, only to hear nothing. This was a year ago and I have now had to contact the Financial Ombudsman to try to get some help to resolve the situation. The bank have again sent the I&E form which I have now completed and got the proofs photocopied ready to send. It has taken a year and I am no further forward. We are now living in local authority housing and are trying to pay out more than what we have coming in. One of my creditors is Nat West Bank, I owe them roughly what they owe me in bank charges, although I have arranged with them through the CAB & CCCS to pay them something back every month. The only question I have now is, is anyone else in this situation? and are Nat West likely to mess me around and try to get out of refunding me my bank charges because I am in hardship and cannot pay off my bank loan from them at the agreed amount every month? Has anyone out there got any answers to these questions?
    If so please reply as I am unsure of my current situation.

    Do you have priority debt arrears(mortgage/rent, council tax, utilities)?
    Are any of those arrears part of a payment plan?
    Were the letter sent recorded delivery and where were they sent?

  • I understand you can claim for Nat West business account bank charges but can you claim if the account has been closed and the Ltd Company has ceased trading and struck off the register at Companies house? If so, who can claim the Director or any account signatory?

  • No I only read on MSE site that you can claim for Nat West business account charges. I was just asking a bit more about that ie. can you claim if the company account is now closed and the actual Company has been struck off at Companies House? If that was possible, who could claim, a former Director of the Company etc?

    Sorry we were on cross wires there. If the company is liquidated then unfortunately you can't claim the charges back.

  • hi just wonder if anyone can help i started a claim to claim bk my bank charges in about feb -mar 2007 from hsbc and lloyds tsb i received mine from hsbc but all i got from lloyds was sorry to hear about ur complaint and nothing else and then the hold came into place about 2 months later i just wondering where do i stand should lloyds of paid me out or do i have to wait for this court case to be finished

    Any claims not paid out before the FSA waiver came into effect (27th July 2007) will have been put on hold and will have to wait for the outcome of the OFT test case.

    Have you written to Lloyds since their April/May 2007 letter?
