hi now this is probably a totaly useless question but can i claim my charges back from proir to my bankruptcy. I eventually had to do the deed of going bankrupt as the charges upon charges finally made our bills totally out of our league. I did have balances on them but they are now cleared as im discharged.
The money would be great but i have a feeling its a bit naught to ask for the charges to be returned to me.BSC member 137

Most likely not.
For example, what would happen if you were owed money during your bankruptcy, but didn't ask for it back until after you were discharged?
My guess is that someone might see this as unlawful.
However, I'd be really interested to know the answer (it might still happen to me!!!) so if you find out please let us know0 -
hmmmm very true, dont want to rock the boat and unearth anything thats not included in my br. Have to say i waited nearly 3 years to finally go br, and now i look back and it was the best thing for me personally. At least i can answer the door, phone , post and not worry :-)

What is the latest on Business Accounts vs Personal Accounts?
A friend, a self-employed sole trader, racked up a lot of charges several years ago and complained to the Bank, who told him it was a Business Account and therefore not covered by the present proceedings. Is this true?
Surely if something's not fair, it doesn't become fair because of the type of account?
Also, is the time bar from the start of the first claim, or from now?

It's right with regards to the basics ie the OFT test case is not about business charges, however, should the bank charges test case go against them then there maybe a read across to business accounts. The current OFT test case is about UTCCR 1998 which is consumer law. However, UCTA 1977 may be the place to go with regards to reclaiming charges.0 -

They called me up earlier and said they can do all the process for me at cost of 49.99 and Ithey will give you money back if the claim isn't succesfull.
I know some people are using companies like them, but just wanted to hear some opinion.
Obviously, if I do everything myself, I can save 50quid....0 -

For £50 all you get is a pack of template letters, which are available here on MSE for free. If you want them to actually deal wth the claim for you then it's another 20% + VAT. Barge and pole come to mind.0
