Overdrafts are different and a letter detailing terms of the account would be sufficient BUT if this was turned into a loan, then i am assuming it was subject to a loan agreement? Does your wife remember signing anything? I would send a subject access request to HSBC as this should include any info relating to the loan account. In the meantime you could write to Metropolitan and tell them the account is in dispute and you are awaiting paperwork from the original creditor. These are just suggestions as to how i would do things. I hope you can get it all sorted

Can someone give me some advice please, I am going to contact my bank to reclaim my bank charges and also claim financial hardship as I fit the critreria, can someone advise me what the 1st step is??

First time I have logged on here although read the forums with interest....I have just tried to claim back charges from TSB ranging to £5k+ under the financial hardship rules but they say that as my account with them is closed they will not assist until the case is resolved....one of the reasons I closed the account was their lack of humanity and also all those charges which just added to the woes of the time....I do intend to take the matter to FSA, but let's face it, they are run by the banks anyway, so will they actually help?0

Please help me, I have received a reply from my bank registering their receipt of my complaint. I understand the the case is now on hold, what I wish to know is what I do next, do i send the final template letter again asking for payment or do I wait for the case to be solved???0

I would suggest you ring the Financial Ombudsman Service and ask them for clarification on that. If they think you have a case you should be able to submit a complaint to them to deal with.
I'm not sure if the FSA deal with individual cases???One step at a time0 -

Hi Arnie, sadly, once a claim is submitted, we just have to sit back and wait for the test case to be concluded.One step at a time0 -

Hi all, would like to share my story with you. I have claimed back my charges on 2 accounts with HSBC sucessfuly before the court acction, however I had another account with them and proceeded to claim the charges on that £2000 approx, I have been on hold from then but recently applied for hardship, I filed in a i/e which they say didn't receive, I then answered thier questions over the phone, I received a call 2 weeks later and asked further questions regarding my financial circumstances I was told a decision would be made and a phone call would come the following day, sure enough they called back and said I could not get the refund as I had made purchases for cloths and had a meal out £30 (naming the pub) and should not have been out.....(bought my children birthday presents) they had been monitering my account. I have since calculated they owe me £675 over 3 accounts since the last claims. any comments?0

Hi Miller. I don't know enough about hardship claims. I always suggest people ring FOS to ask for advice, as i've found them to be really helpful. It may be worth looking at the consumer action group forum too if you can't find any useful information here. Hope you can get it sorted.One step at a time0
