Hello
Just need a bit of guidance about claiming my bank charges back from Halifax. I sent them a number of letters last summer but I decided to see how the test case panned out. I haven't really followed it up . Is there any chance of getting back my charges now? They total just over £2000. If so how do I go about re-starting my claim against Halifax? Can anyone help? Thanks.0 -

Hi,
You may be able to claim back your charges if you can prove you are in hardship. I had to fill in a expenditure form listing my outgoings, any payment arrears, benefits etc. (my bank is NatWest). From this, they make a decision as to whether they think you are in hardship. If you decide to go for this, it would probably be worth stating that you have an existing claim so you don't have to start the whole process from scratch...
Check out the bank claiming in hardship thread on here for more advice/info.
I'm not sure where to go from here if you are not in hardship though....0 -
Hi
I am claiming Financial hardship with N/West.I have submitted the forms and now they have requested an updated copy of the arrears.
The BOS sent the wrong letter and now I have to wait for the new letter stating the current arrears.
They have said that there should not be any problem!
How long did it take from submission of your forms, for you to recieve the letter re - repayment to PPi and the length of time to receive the cheque.
I
hope that you dont mind me asking.SPC £500 well will try very hard.

Hi there!
I just looked at an October bank statement and there is a default charge of £14 showing on my statement but I had money in the bank at this time. Does anyone know what this could be possibly for before I ring the bank and start ranting and raving?
I honestly cannot see what it is for as I cannot have missed a payment. My account did not go into minus figures.
Cheers!
Kris
I'mnotsure what it's for. Sometimes it not always necessary to rant and rave. Ring and ask 1st a) what it's for and b)can they refund it! Good luckOne step at a time0 -
Last year I applied to HSBC for £105 in overdraft fees - I got the usual "nice try, but no" letter.... but now what do I do? I'm confused as to what I can do next?
You need to write back to say that you do not accept their decision and make it clear that you still believe they should refund you. You then need to wait for the outcome of the test case. There is probably a follow up template letter on this site. One step at a time0 -
Hi.
Received mail that I was to be charged £80 for a £2 unplanned overdraft on an account I use for paying a £15 p/m phone bill and nothing else (So I don't really check on it)
Turns out, my credit card (with TSB also) was a day late (I hadn't received a statement, could have just been erratic Christmas post or something) and they'd dipped into the bank account, which is apparently in the t&c. So when the phonebill came out, it was OD. I had no idea any of this was going on until I received a charges note - I'd have paid £2 immediately had I known, of course!
They've wavered charges from December, but insist on keeping the January ones. Being charged £80 for £2 is ridiculous, is there anything I can do? Account is no longer OD, credit card is cleared. Yet they won't budge.
You could try making a formal complaint and see if they will refund it that way, as it is unreasonable to charge so much. Keep your complaint factual - what happened, what they did, what you want them to do to sort it out.
If you exhaust their formal complaint system and they do not refund the money, submit a standard refund letter and await the blinkin' test case! One step at a time0 -
I am writing on behalf of my wife. she had a student account with HSBC but after some financial difficulties her debt got moved to a managed loan, she then missed some payments due to financial hardship and it got sent to MCS.
We sent the letter asking for the the signed agreement plus the £1 postal order.
I got this letter back today without the £1 postal order.
Any help would be most welcome.0 -

Overdrafts are different and a letter detailing terms of the account would be sufficient BUT if this was turned into a loan, then i am assuming it was subject to a loan agreement? Does your wife remember signing anything? I would send a subject access request to HSBC as this should include any info relating to the loan account. In the meantime you could write to Metropolitan and tell them the account is in dispute and you are awaiting paperwork from the original creditor. These are just suggestions as to how i would do things. I hope you can get it all sortedOne step at a time0 -
I have read through the financial hardship guide for reclaiming charges and most if not all apply to me. I have an Abbey account and need to know where I need to tell them I think the hardship rule applies to me.Do I tell my local branch or go to head office?0

I would always suggest putting things in writing so that you have a record of everything that's been said by you and them. I would send letters to head office. If they turn you down you may wish to take your complaint further so it will be useful to have evidence. Good luckOne step at a time0
