    Ok well due to not having the money to pay via a court case i went through the 'complain to the financial ombudsman' route instead.

    Does this current ruling not change anything and both the ombudsman and court cases are still on hold and could be for some time. Have I read that right?

    hi all after reading that the big case is over

    i find myself confused as to what to do now,
    i went throught all the procedures last may with my bank & applyed to take them to court & it was put on stay,
    so i ring my bank this morning & they told me their will be other hearings & i have to wait till they get in touch with me which might be a few months ??
    so i rung my court & they told me to either wait till my bank contacts me or write a letter to them to lift the stay now & carry on the court case my self, to reclaim,
    so what should i be doing

    It is not over. You have clearly only read the headlines, and not the substance.

    The judges has ruled that the charges fall under the unfair terms in consumer contracts regulations. This is indeed good news, as they do state that charges should be relative to their costs.

    But he also stated that this does not mean that they are unfair.

    The next hearing is in May, and although this is good news, it does not mean anything has changed - yet. The banks have until 22nd May to decide if to appeal.
  • I go to the Court of Session on Friday 25 April in an effort to reclaim very substantial damages against Royal Bank of Scotland. This case has a public interest element and as such RBS has tried, unsuccessfully, over the last three years to keep me out of court. depending on the judges decision, I trust that the case will be allowed to a full proof hearing with expert witness evidence to show up the deceit, dishonesty and vindictiveness of RBS and their personnel.

    Couldn't believe it saw two £35 charges for two £10 failed items. Couldn't think what these £10 payments would have been for as I have not paid anything useing the account for 2 months. Went to bank yesterday and found out it was the cheques 2x£10 I had sent to cover data info for both accounts over 2 months ago, funny how it was just getting took off now and charge of £70 total being took today 24th, told girl in bank I want an extention to pay charge and have it put back to be took on the 24th may hopefully will have money to pay it then ,also will try and claim it back as my other reclaim stuffs already sent and waiting to be dealt with...:mad:

    If you have a case of genuine financial difficulty, your bank or building society must still deal with your complaint. This may involve – or not – the repayment of charges. See the Banking Code for how they can help. If you're not happy with the firm's response to your complaint, you can take it to the Ombudsman, who will consider whether your complaint can be dealt with before the test case process is resolved.

  • Hi, My bank charges accumulated to a point I wasn't able to keep up with the payments My account was passed to creditors about 12 months ago. Will I still be able to reclaim?????? :confused:

    I paid a bill on-line as I thought there was enough money in my account. However the available balance on the Lloyds TSB page first page after you have logged in does not show. It only shows the Actual Balance which is different. Unless you remember to click on a particular account it won't show you what is actually available. Anyway my point is that there was not enough 'available' money in my account to pay the bill I wanted. The site however did not say it could not complete the transaction and as far as I was concerned it would be paid. However shortly afterwards I received a letter stating that I would be charged £25 or thereabouts for an unauthorised overdraft after it was paid. What a cheek! The database would have known there was not enough money and should have rejected my request there and then and not paid it and then charged me an extortionate fee. The only cost to the bank was the fee to post the automated letter. If I had actually gone into the bank to try and make a payment the teller would have told me verbally the available balance was insufficient but because I tried to do it on-line it accepted it and charged me! Internet banking saves the bank money. I have two points to make: Lloyds - start putting the 'available' balance as well as the actual balance on the front page once you log in. Secondly, Get the computer to reject transactions that would lead to an unauthorised overdraft. Has anyone else been caught out like this? Incidentally, I got my money back after I wrote a stinking letter to the bank telling them what a good customer I had been for 25 years, and I had got an expensive loan with them and a rubbish savings account. They make enough money out of me.
  • If I put my claim in in November 2007 ( I was made a small offer but refused) then claims were frozen. Will my claim be 6 years from November 2007 or 6 years from the date of the judgement. Was wondering as it says you can only claim back 6 years but from the date of my claim it would be 6 and a half years?

    Glad you got your money back, Lloyds TSB are a law unto themselves, I have had so many problems with them over the last couple of years it's unreal. Even considering I have been with them 19 years. Lloyds TSB website takes some getting used to, and it is so annoying trying to actually get any information without having to resort to phoning them. My account was recently sent to their Collections Department. Because I become unemployed and missed my Loan payment. What a farce, Nobody would take responsibility for my account, I spent in one month £11 on phone calls, because it turns out that Lloyds TSB, Lloyds Collections, Lloyds Loan Dept, etc etc are all separate companies and are not connected in any way. How my prebooked interview at my branch was to be shown into a room with a telephone!!. Whatever happened to the personal service I originally signed up for? Maybe we should start reclaiming the Services we originally signed up for when we opened accounts with the Banks in question.
  • Hi people - new to this so bare with me ! Hopefully someone can advise on my question as follows;

    If i have only been with my current bank(Nationwide) for past year can i put a reclaim into my previous bank(HSBC) for the 5 years previous ?
