Reclaim Unfair Bank Charges article discussion Part II

As the Clydesdale/Yorkshire in particular tend to assume that by cashing the cheque you have accepted their offer so rather than keeping it in part payment, tear up the cheque and send it back and tell them you will be continuing to court for the remainder.
The FO are not taking on further cases so if you go down this route you will need to file a claim with the courts. Please read Martin's Emergency Guide for further information/help.

I know that when we send the letter threatening court we have to give 14 days notice but is it the same the other way round??
I missed one of my re-payments and their solicitor sent a letter saying I had 7 days from the date of the letter (so really I only had 5 days including the weekend). is this right????

My son wrote a cheque for £70 it wasn't cashed for a while and he withdrew £60 from an ATM, three days later the cheque was taken from his account which left him £10 over drawn. He doesn't have an overdraft and has never been overdrawn before. He wrote to the Nationwide and asked as a gesture of goodwill would they refund the charge of £20. They refused and he deposited his part time jobs wages but when they took the £20 charge they effectively made him overdrawn again and they charged another £20. I got him to write again pointing out the fact he is now a student and will shortly be depositing his student loan (as he did last year) with Nationwide. We got his reply today which was another refusal. I spoke on the phone to them today and expressed my disappointment that they would not look favourably on his request. They just would not budge, I have told them he would be banking else where and taking his complaint to the ombudsman. I am so cross at the lack of not seeing the forest because of the trees. Is this worth pursuing or do I just write a letter of complaint and bank else where?0

personally if it was me i would still bank the cheque wait till it clears then go in an close the account and see what they say then.....that would make them see that you mean business............nothing to lose

I sent off my first letter, I got back a reply and they told me that are undergoing a court proceedure and therefore was entitled to freeze any request for any claims, what shall I do shall I just wait untill I hear back from them?0

I'm claiming over £1200 from Lloyds - sent usual letters, referred to FO when the test case thing kicked in - thought - JUST MY LUCK!! but on Friday, got a letter from the FO saying that because it appeared from my claim that the bank charges had caused me financial difficulties, they would carry on looking into it! I was shocked as I thought the test case meant a stop on all cases - clearly not! Will let you know the outcome as the FO says they are requesting info from Lloyds about my case. Fingers crossed - Lloyds will cough up.0
