    Hello Robinpianoman I am so glad I read your post ! You have put down almost the exact same thoughts I did over on CAG site. my sentiments exactly!! I don't want to swear on here, but what the hell is going on!!
    We should be seriously worried, I quote from an article in the Daily mirror, by a politician( can't remember name) " This is the Biggest Bank Robbery in Britain"

    About my claim, I am one of the '600 Cardiff 14th August, 10.30 am' blanket stay. lots of us turned up on the day handed in our application for uplifting the stay and objections. weeks later received the court REFUSAL to remove stay, I sent in an appeal against this and asked for the oral hearing again. today I received a court letter saying that the hearing of the claimants application for Oral Hearing RE: refusal to remove stay will take place at 10.30am on 19th October at Cardiff County Court.

    I have sent letters to MPs the MOR, MEPs Rhodri Morgan, National Assembly members, the FSA,Western Mail and every response is simply passing the buck or not want to know and template FSA letter

    What concerns me as well is that our leaders Martin, Mark (CAG) and StephenHone(Penalties site) have seemingly gone silent of late and to be honest we need we are not being heard without them
  • Back to the drawing board for me. Just before going to serve notice for non payment I checked the mail and had a letter from the court saying the bank had asked for the judgement to be set aside and a order from July 12th to be varied (that told Barclays they had to file a proper defence or I could ask for judgement to be made, and they failed to respond which meant the judgement was made against them).
    Now have to go to court on 7th December to hear set aside judgement - 10 minutes allowed.
    Can any one tell me if I can get this brought forward or struck out now because of hardship grounds?
    Reality is Barclays failed to file so case was awarded against them. They say they did not get July letter but is that a valid defence?
    Need help as need the money NOW and getting peeved about extended delays :mad:
    PS THanks martin for starting all this as your advice and these forums have been invaluable, if only for keeping me sane.

    I have just started to claim my credit card charges back and have got my list from the bank. Do you know if I can I also claim back "credit card repayments insurance" which, according to my statements I was paying every month!

    Claimed £4992 over the past six years and judgement was given today awarding me the full amount, plus interest and costs ... HSBC ordered to pay £5257.22 forthwith!

    The template I had used for the claim was from another site (tut tut tut) and neglected the interest details, so I missed out on about £800 worth, but I am morew than happy with the result.

    Just go to wait for them to pay up, now.

    I am really really pleased 4 u on ur victory over hsbc .
    What i would like to know is when u went to court did they try and stop the claim because of the test case because they have with my claim and the judge has ordered a stay until test case concluded.
    I was wondering if Hsbc are still paying out then would i be able to appeal the stay on the grounds that they are still paying people
    some help and advice would be appreciated

    I received a letter from their solicitors saying that they were going to apply for the stay, but it seems that they didn't. Not quite sure what/why. I do understand that if they apply for the stay that you can appeal against it - template letters are (apparently) available on here somewhere.

    Note that I never actually went to court. I got a "Notice of Allocation to the Small Claim Track (No Hearing) letter on which HSBC were ordered to provide a full breakdown of all charges and to justify them or their case would be struck out, which is what happened.

    Although I have the judgement, I am yet to have the money in my hands - not sure how long they take to pay up after they've lost the case.
    We missed out on the reclaim of nearly £5000 bank charges from HSBC, but picked up over £10000 in PPI claims against them instead. I am now debt free and working to help my other half clear hers
  • hi. i'm new to this site so i apologie if this is in the wrong place!

    having successfully reclaimed £300 of bank charges myself a few months ago (thanks martin:T ), i got my mum to do the same (she asked for the back statements before the OFT stepped in but hasn't sent off the reclaim letter yet).

    my mum, not the banking brightest!, has gone overdrawn several times by a few pence and when she went in to the bank (the alliance and leicester) to ask how much she needed to put into the account to pay off the overdraft, they've not included the amount she's being charged for going overdrawn so she ends up not paying in enough to cover the charges, thus going overdrawn again and being charged again.

    this has racked up hundreds in 'unauthorised overdraft charges,' plus she's been charged hundreds more in 'monthly overdraft charges,' a load more in 'failed cheque charges' and more again in something called a 'paid item charge.'

    she also has been paying for an overdraft protection plan that she didn't know she had, and i think they've been charging her a onthly fee to have an overdraft when she thought it was free. and she was only sent copies of her bank records dating back 3 years (although she's had the account for longer).

    my questions are:

    1. in light of the OFT stepping in recently, can she still write to the bank to reclaim or is it too late?
    2. if so, which of the above charges can she claim back?
    3. is there any way of claiming back for being mis-sold the 'overdraft protection plan'?
    4. anyone know what a 'paid item charge' is and can it be claimed back?
    5. can she get her bank records for the full period she's held the account, and if so how?

    Hello everyone, thanks to you and martin for helping me earlier this year in getting £730.00 from barclays bank, but am now looking at store card late charges, can this be done??, it's for a house of fraser card, with GE Money, totals £133.48. Got a letter ready to send.... should I??

    I've had all my paperwork returned to day by the FO !!! with a nice worded letter telling me that they will put it back into the hands of lloyds bank and that lloyds will contact me after the test case has finished
